MINUTES OF PLANNING BOARD -2- 5/1/08 <br /> <br />Next on the agenda is a proposal for a sign for 2649 East Main Street – Downtown Quesadillas. Mrs. <br />Gabriella Owen actually brought her sign in for review. Mr. Morris stated that she would have to <br />supply this office with color samples. It was stated that there is no lighting for this sign. Ms. Owen has <br />updated her application and initialed all the updates. It was stated that the sign conforms to all Village <br />Zoning Ordinances. Mr. McCormick made a motion to approve the sign contingent upon the color <br />samples being supplied, seconded by Mr. Chase. Unanimously carried. <br /> <br />2776 WEST MAIN STREET, CAFE MAYA <br />Next on the agenda was the proposal for change of ownership of the former Dirty Bassdardo's to Cafe <br />Maya and a new sign at 2776 West Main Street. Mr. Luis Pinto the applicant and Mrs. Juliano the <br />owner of the building appeared. Mr. Morris stated the first item we will talk about is the change of <br />ownership – he stated that Mr. Pinto will have to apply for a new Certificate of Occupancy in his name. <br />As far as live entertainment – if they plan on having live entertainment – I believe you have a <br />gentleman who roams around playing the guitar – if you would like to “put that on the table” tonight – <br />then we can address it all at once. The type of entertainment we are discussing is a gentleman who <br />roams around the restaurant with a guitar and a small amplifier who goes table to table. Mrs. Juliano <br />asked if he could have the same restrictions on his Certificate of Occupancy concerning live music as <br />she had as a previous restaurant owner and Mr. Morris stated Mr. Pinto's Certificate of Occupancy <br />would include the same restrictions as Mrs. Juliano's did. Mr. Pinto stated he would be open 7 days a <br />week. Mr. McCormick made a motion to approve the use as Cafe Maya contingent upon all prior <br />contingencies being included in his Certificate of Occupancy – motion was seconded by Mr. Moran. <br />Unanimously carried. <br /> <br />Next the sign was discussed. Mrs. Juliano stated she did not have the color samples with her this <br />evening but she would bring them to the Zoning Office tomorrow. The square footage of the sign is the <br />exact size as the existing “Dirty Bassdardo's” sign – (7' x 4'). The sign will have the exact same <br />lighting and there will still be the same changeable area down below for messages. After reviewing for <br />conformance to the code Mr. McCormick made a motion to approve the sign as presented contingent <br />upon: (1) color samples being brought to the zoning office and sign continued to be lighted by <br />gooseneck lighting. Motion was seconded by Mr. Moran. Unanimously carried. <br /> <br />TBN NOVICK, 28 MARKET STREET <br />Next on the agenda was the proposal from Michael Novick for a grill/restaurant at 28 Market Street. <br />Mr. Michael Novick is the applicant. Mr. Morris asked Mr. Novick if he was planning on putting <br />tables and chairs in the space and he answered yes her was – but just a few maybe 6/8 and Mr. Morris <br />reminded him he would have to work with the Code Enforcement Officer to make sure he did not <br />violate the Fire Codes. Mr. Morris asked the status of the facade of the building and Mr. Novick <br />answered that he had a Certificate of Occupancy and Mr. Morris went on to state that he had left the <br />issue in Mr. Fenton's hands. Mr. Morris asked Mr. Novick if he had a space for his dumpster and he <br />answered yes he did – he has a trash corral with a wooden fence – at this moment he has six (6) <br />commercial garbage cans for the tenants and as needed he will put in more commercial cans for <br />perspective tenants. Mr. McCormick made a motion to approve the use as a grill/restaurant contingent <br />upon seating being approved by the Fire Inspector/Building Inspector. Motion was seconded by Mr. <br />Moran. Unanimously carried. <br /> <br />Next the sign was discussed. It was stated that the space is 30 linear feet and therefore only 15 sq. ft. of <br />sign is permitted. According to the proposed sign permit application – the sign conforms to the code – <br /> <br />
