A Public Hearing on a proposed Local Law entitled '~ Local Law Amending <br />~he Zoning Ordinance of the Village of ~appln~rs Falls with re~ard$ ~ <br />~on~n~ permits was held on Wednesday~ 5-14-80 at 7:~0 ~.M. in the ~erican <br />Legion Hall. <br /> <br />Present: Mayor Synnett, Tr. Dolan~ Tr. Moruzzi, Tr. $ilvestri, Tr. Costa, <br />Tr. DiGregorio, Tr. Viglotti and Atty. Lyons. <br /> <br />Atty. Lyons reported each member of the Board previously received a copy <br />of the Local Law and the purpose of same was to eliminate the necessity <br />ob a ~uilding permit for making repairs to existing structures. <br /> <br />Zoning Officer Haubennestel stated he didn't concur as same would cause <br />difficulty. He read the following statement: <br /> <br />Reference is made to proposed Local Law #1 of the ~ear 1980, amending the <br />Zonlr~ Ordinance of the Village of Wappingers Falls, with regard to zoning <br />permits. The attention of the Board of Trustees is directed to the fact that <br />in nearly every instance of repairs, such as p~rches~ garages and other sub- <br />structures, demolition of same is required before repairs can be effected. <br />Therefore, in the opinion of this.office, any person who might be within the <br />required limits of expense specifled in Local Law #1 of 1980, they would still <br />be libel to obtain a demolition permit as required by ~qection 512 of the <br />Zonin9 Ordinance. <br /> <br />It is respectfully recommended that the Board of Trustees add an additional <br />paragraph, in which all persons proposing to make repairs as outlined~ shall <br />be required to notify the Zoning Enforcement Officer and submit a signed <br />statement where the cost of repairs does not e~ceed an amount equal to 25~ of <br />the fair market value of ~he building or structure above the foundation. This <br />will eliminate reports from interested parties that work is bein9 done on <br />a structure without a building permit beihg visible and will save the time <br />of the Zoning Enforcement Officer and his office from investigating unnecessary <br />complaints. This matter has been discussed with the Village Attorney, and in <br />my opinion that he has no objections to the proposal. I respectfully recommend <br />that the Board of Trustees include same if and when Local Law #I of lg80 is <br />adopted. <br /> <br />Atty. Lyons reported he agreed with Mr. Haubennestel in that anyone who <br />undertakes repairs should file a simple statement with his office so he is <br />aware repairs are being made. <br />He saw no necessity for a demolition permit. <br /> <br />Tr. Viglotti inquired if fines would be ~eco~ended if forms are not <br />s~bmitted &~d Mr. Haubennestel replied it could be a punishable offense. <br /> <br />Tr. Viglotti inquired if it was a good idea to ask l~eople to pay a fee to <br />repair existing structures. <br /> <br />Atty. Lyons reported purpose of the Local Law was to encourage people to <br />~ke repairs and Zoning Officer's recommendation would require an ~me~dment. <br /> <br />Atty. Lyons stated demolition permit procedures would require the tearing <br />down and removal of a building. <br /> <br /> <br />
