Mr. Fenton stated plan was compliant to the Code but according <br />to the code - the Planning Board determines the side yard setback. Mr. Fenton stated if <br />the Planning Board approves the plan - he will need a set of detailed drawings. It was <br />Stated that the side setback for the building is 7’ at its narrowest and the portion where <br />the addition is going to be built would be 9’. He would actually be building an addition <br />to the storeroom between the existing cooler/freezer unit and the kitchen and then putting <br />a roof over the cooler/freezer, new addition and 8’ open space for compressors. The <br />reason why he wants to extend the roof over the entire space is so they can have a <br />covered walkway when you come out of the new door and go into the door of the <br />cooler/freezer unit. It was stated that the roadway on that side is not used for vehicular <br />traffic - it is mainly a walkway. Mr. Morris asked if the compressor was electric and Mr. <br />Muhlenbruch stated yes it was - and Mr. Morris asked if the noise from it was similar to <br />an air conditioning unit and he stated yes. Mr. Paggi stated he has no concerns with the <br />proposal but he would like to go on the record as saying that there is an existing sanitary <br />sewer trunk line that goes right across the property - reputedly under the existing <br />building. He went on to state that at some point the Village will need to replace it - there <br />are plans in the works as we speak and the Village will need an easement somewhere <br />along the depth of the property from the north to the south - the Village would ask for an <br />easement of about 25’. Mr. Paggi just wanted to make the point that anything the K of C <br />does going East/West will limit the Village’s efforts. The trunk line takes a significant <br />flow from the Village. Mr. Morris asked what the current schedule was to replace it and <br />Mr. Paggi stated that the Village has applied to the Environmental Facilities Corporation <br />for funding in Albany - it is part of a 10 part project - but it is not within the first three <br />that will be done - approximately at the end of 2010. Mr. Kocan recommended that the <br />alleyway be reserved for a potential easement. Mr. Horan asked if the alleyway was <br />attached to another property and Mr. Muhlenbruch stated it goes straight back and meets <br />with another right of way from High Street. Mr. Morris stated that the Planning Board <br />needs to get clarification for the following (1) Does Central Hudson actually have an <br />easement, (2) and if they do have an easement does the building encroach upon the <br />easement. Mr. Fenton stated he felt what had to be done was that the Knights of <br />Columbus needed to contact Central Hudson and mark out the easement. Mr. Morris <br />stated we need to have a record of the easement and secondly we need it marked off so <br />the Planning Board knows that the addition will not encroach upon it. If it does not <br />encroach upon it - then the Planning Board can proceed. Mr. Morris stated the Planning <br />Board just wants official confirmation that they are not allowing construction on top of an <br />easement. To sum things up - Mr. Morris stated that before any approvals are given the <br />Knights of Columbus would have to give the Planning Board (1) a copy of the easement, <br />(2) have the easement marked off and (3) update the site plan. <br /> <br />No one was present for the next four items on the agenda. These items are as follows: <br />(1) Proposal from Terri L. Davidson to be able to use a suite at 1562 Route 9 for a <br />Church, (2) Proposal from Joseph V.
