Mr. Paggi was just concerned that he did not want to violate SEQRA by <br />beginning the repairs. Mr. Paggi stated he will be undertaking the repairs as soon as <br />possible and he will be coming into the Planning Board with an application very soon. <br />Mr. Morris stated as long as the repairs are restricted to the originally approved section <br />and it does not encroach into the newly proposed area and work does not expand upon <br />just repairs. Mr. Jay Paggi stated the only thing that may happen is that the existing drain <br />pipe as it goes through Section 13 may be realigned to be consistent with the new pattern <br />in Section 13 and Mr. Morris stated that is not a problem. Mr. Morris asked if there were <br />any updates with the proposal for expansion and Mr. Paggi answered they would <br />probably be back to the Planning Board in the next two months with an application. Mr. <br />Morris then stated that applicants would have to put $500.00 in escrow to pay for any <br />work that has been done up to this point by the Consultants. <br />Header……….. <br />Next on the agenda was discussions with Nicholas T. Chase with a proposal to use 35 <br />Market Street as overflow parking for All Tow vehicles (business located at 33 Market <br />Street). No one was present for this hearing. <br /> <br />CREEKVIEW SPRINGS, LLC FOR FRANKLINDALE AVENUE <br />Next on the agenda was a public hearing on the proposal from Creekside Springs, LLC <br />for the following: Two 3000 sq. ft. 2 story 4 unit buildings and two 4500 sq. ft. 2 story 6 <br />units buildings at Franklindale Avenue. Mr. Mark Day and Mr. Dennis Lynch from Day <br />Engineering and Mr. Dave Stenger owner of the property were present. Mr. Day stated <br />what they are here for tonight is to discuss some of the changes that were made at the <br />request of the Planning Board and they had also met with the Fire Chief and made some <br />changes as an outcome of that meeting. He stated that the Fire Department did not have <br />any objection to the turning radii but they wanted all curbs to be fully mountable - they <br />also think they have the issue straightened out with the Tri-Municipal Sewer line - there <br />is a great mystery as to how everything is connected - Franklindale Avenue used to <br />continue down the path and continue - there is manholes that do not appear on any plans - <br />there is a meter pit that no one seems to know when it was put in - how it was put it or <br />what it does - Mr. Day received today from Highway Supt. Tom Marshall dated 1918 - <br />and he also received survey plans from the former owners of the property - the Board of <br />Health had little information - but through all the above - he feels that it is being <br />straightened out - he only received these plans this morning so they were not able to sort <br />everything out - they are going to meet with the Chief Operator from Tri-Municipal to <br />discuss it with him. Mr. Lynch put together a rendering to show the placements of the <br />house and surrounding areas. It was stated that there is a memo from New York State <br />Office of Parks, Recreation and Historic Preservation (Shippo) dated August 18, 2009 on <br />file in the Planning and Zoning offices and a memo from the DEC dated August 25, 2009 <br />on file in the Planning and Zoning offices in response to our Lead Agency request. Mr. <br />Day stated that they have retained Mr. Mike Nowicki to review the issues raised by both <br />MINUTES OF PLANNING BOARD -3- 9/3/09 <br /> <br />the DEC and SHIPPO.
