Attorney Viglotti said this proposed local law is to codify existing
practices. Village is responsible at the street level and the property owner from the street
connection to the structure. If a building owner notifies the Village that they are having a
problem with their building sewer connection (i.e. lateral), the Village shall immediately
check the main line in the street in front of the building to insure that it is flowing freely.
Any blockages in the Village sewer main shall be corrected by the Village.

The Village shall notify the building owner if the Village sewer main is flowing freely. If
the Village main is flowing freely and the building connection (lateral) is not, it shall be
the building owner’s responsibility to hire a qualified firm to mechanically snake and/or
jet the building connection to get it flowing freely again. Any blockages in the building
connection (lateral) from the house to the Village main shall be the responsibility of the
homeowner to correct. This includes tree roots intruding into the lateral if they are
causing a blockage. The Village shall have no liability in clearing any blockage of any
kind along the entire length of the building connection from the house to the Village
main.

If the homeowner’s contractor believes that there is a physical break in the building sewer
connection, the location of the break will need to be documented via proper internal
television by the homeowner’s contractor of the building connection. If a break is found
Page 1 of 5
