Minutes of Public liearing on Sewer Ordinance held Wednesday, Septl 29~ 1971 <br />at Mesier Homestead at 7:05 F~. <br /> <br />Public Bearing was called to order by Mayor Furnarl who requested attesidance <br />be taken and advised that Josephine C~rino was substituting for Leo Lowney, <br />Village Clerk, <br /> <br />Board Members present: Mayo. Furnari, Tr. DiDomizio, Tr. McCluskey, Tr. Synnett, <br />Tr. Dolan, Tr. Rain, Tr. Sullivan, Village Atty. Lyons and acting secretary <br />for Vi.]lage C~etk, J. Cerino. <br /> <br />Dr. Lyons read Notice of Public Hearing that was advertised in the #appingers <br />Shopper, official Village Newspaper. <br /> <br />Tr. DiOomizlo stated the Sewer Ordinance is a new Comprehensive Ordinance and <br />read contents of Ordinance - Sewer Main Order and Water Line Maintenance in full. <br /> <br />AttFo i~ons stated the Sewer Ordinance is of the. utmost interest to the Trustees <br />and it is necessary to qualify for State and Federal aid for the secondary treat- <br />ment. The proposed Sewer Ordinance is euite technical and Adler and Brenner, <br />Village consulting engineers, would have to answer any technical questions. He <br />stated the Ordinance is designed to protect sewer system, treatment plant and <br />protect the receiving water to stop infiltration of sa rface and storm ~aters. <br />He stated the engineers suggested that in additon to the usual penalties that <br />provisions of Sewer Ordinance be enforced t>y cutting off water supply to those <br />in violation. This would involve action on the part of the Water Co~issiono <br />Any uae of Village ~ater which results in dangerous or toxic ef:luents would <br />result in action for stoppage.. <br /> <br />Mayor Furnari stated if the New Ordinance is ~ssed, The Village would be respon- <br />sible for taking up curb from one side of street to the other and would bear these <br />expenses. The taxpayers involved ~uld be relieved and all the taxpayers would <br />shanre enually in the burden. He then opened the meeting for questions and reques- <br />ted all to state name and address if they wished to be recognized. <br /> <br />Mrs. Alice Johnson, 2 Gilmore Hlvdo, inquired if any household detergents would <br />be dangerous to the plant. ~ro OiOomizio replied "no" this is aimed at commercial <br />use. Concern over phosphates is more prevalent in areas not serviced by treat- <br />ment as werare. Toxic effluents isn't aimed at residences only commeroialo <br /> <br />Mel Halloran, 72 Pa0gi Terrace, questioned if someone is in violation but ia <br />not aware of it and immediately takes steps to correct the situation would they <br />still be liable to pay the $250 fine per day while waiting for the work to be <br />completed. <br /> <br />Atty. Lyons stated it would be hard to see where there would be a violation d <br />maintenance without being aware of it. With respect Lethe New Comprehensive <br />Sewer Ordinance, a provision is made /or notice in the event of any violation in <br />existence at the ti~£e of Ordinance before a person is subject to penalty, he ~ust <br />be 9iven notice and reasonable time to get the work done. <br /> <br />Mel Halloran questioned if Vullage is responsible for any damage -in the. <br />neighborhood sewer backup. <br /> <br />Mayor Furnari stated infiltration must stop in sewer system. Overflew causes <br />backup. At this point Mayor Furnari advised that 60~ o~ funding would come from <br />Gov't. but all infiltration must be cleared before they will allow any money, <br /> <br /> <br />
