A Public Hearing on a proposed local law amending Village Zoning map pursuant to Section 151-5 and 151-27 of the Code of 'the Village of Wappingers Falls, NY was held on Wednesday, January 9, 2002 at ?:00 PM in the ~nerican Lesion Hall. Mrs. Sassmann, Chairperson of the Comprehensive Plan Committee, read text of proposed law. She 'sai'd above pertained to Zoning map, as amended by Proposal ~4, which was final recommendation of the Comprehensive Plan and discussed areas affected by this change and said Central Business District will be much larger as a result, of' this legislation. M2rs. Sassmann said Exhibit A of said local law was a listing of all designated properties, their~cnrrent and recommended Z 0 ne. Kathy Ceng of Ceng Auto Center inquired as how change~woutd effect their application pending before Planning Board as their property was now in a GB zone and, as a result of above, will be CB. Atty. Viglotti said proposal will p~obabl, y require a variance~ Public Hearing closed. Second Public Hearing on proposed local law repealing Section 151-12 (a) (3) of the Village Code was held at 7:20 PM. Atty. Viglotti said above repeals a section of the Code that disallows p].acement of signage in a Right of Way parking area or roadway within the Village. He said reason Planning Board re~aested repeal was that, in fact, they issue sign pe'~nits and feel they can better govern where signs should go. ~4~. Viglotti said 'there were some Sta'te right of ways over a portion of our main ~oroughfare and some of our businesses ~ere not allowed, under the old section, to hang signs over sidewalks and streets; he said Planning Board feels, if we repeal that section, they can review each application on a case by case basis, decide if it was the proper placeage for a sign and better administrate their sign permit approval process. Tr. Davis said Planning Board has done an excellent Job as to scrutinizing size, placement and safety of signs installed and the State, by approving certain signs in the business district., has set a precedent, and Planning Board wanted to assume authority so that procedumes are car~.ied out properly.
