Special meeting af the Village Board of Trustees was held on March 21,.1973 <br />at TrOD P.M. in the Mesier Homestead. <br /> <br />Those present: Mayor ?urnari, Tr. OiDomisio~ Ti. Oolan~ 'l'r. Synnetts Tr. <br />Sullivan~ Tr. Hoolihan and Atty. Lyons. <br /> <br />Mayor Furnari reported purpose o/.the meeting was to take action on the <br />recent decision from the Dutchess County Planning Rd. regar¢llng the <br />proposed Kent Sussex Shopping Plaza. <br /> <br />Atty, Lyons reported ViLlage Bd. voted to change zoning on the Ma£shall <br />property from Planned Industry to Central Business, subject to recommendations <br />fro~ the DoC. Planning Bd. within a 30 day period. <br />He stated decision has been received disapproving proposed change and.gthe£ <br />action is required, <br />Attyo Lyons stated Village mill need 5 af£ir~ative votes including adopt- <br />ion of a resolution overriding dlsapproval. <br />He reported County disapproved zoning change for the £olleeting reasons: <br /> <br />1. The Commercial Business District use regulations (as eel1 as the liighway <br />Business District regulations in the Town) do not provide for shopping. <br />center development, are not appropriate therefor~ and do not give the <br />comunity sufficient control over development to promote the public interest/ <br /> <br />2. ~he zoning plan for this area shguld be more selective and provide ~ot <br />an appropriate mix of interdependent land uses as well as a transitional <br />pattern of development between coamercial develo.~ent of Route 9 on ~he <br />west and residentia~ grouth to the east, <br /> <br />3. The proposed rezo~ing excessively compounds the fact that the area is <br />over-zoned for com~aercial development and opens Myers ¢~rners Road up for <br />roadside business development. <br /> <br />Tr. OiOomizio reported D.C. Planning Bd, ~hould have been concerned ~ith <br />the ~outh Bills ~all Plaza. <br /> <br />Mr. C~ane, Attorney £or Developer~ reported meetings hel~ and arguments <br />concerning Market ~esearch discussed. <br />He stated developers are ~illing to spend millions oE dot[ars on'this <br />pro~ect to make money and he thouoht it strange that a gzoupd o~ p[anne£s <br />could outthink developers. <br />Mr. Crane discussed traffic and reported plans have been s~b~itted to <br />Dept. of Transportation. He stated road has been discussed ~or the rear <br />o£ the project. <br />Mr. Crane stated Zonin~ Ordo provides many safeguards to insure pr.per <br />developmen~ for the property an~ a change in zoning would not.have <br />any substantial effect on back property. <br /> <br />Mr. ~eitlich reported ~esidents hay& put money in their properties and' <br />market research is overt?rotective. <br />He stated shopping centers are competing ~ith each other and are over zoned'~ <br /> <br /> <br />
