Regular meeting of the Village ~ard of Trustees was held on March 13, 1974 <br />at 7:00 P.M. in the American Legion Hall. <br /> <br />Those present: Mayor Synnettm Tr. DiDomlzio, Tr. !)elan, Tr. Bain, Tr. <br />$ilvestzi~.Tr. Helding and Atty. Lyons. <br />Absent: Tr. Hoollbano <br /> <br />Minutes: <br />Minutes of the last regular meeting held on Feb. 13, 1974 and Feb. 18, 1974 <br />had been duplicated and previously presented to ltoard members° <br /> <br />Motion by Tr. Silvestri~ seconded by Tr. Bain that the above minutes be <br />accepted as duplicated. Carried. <br /> <br />Petit iouu: <br /> <br />Mr. Hugh S. $ilbersteln, Attorney for Clayton D. Seeber, ~]¢iressed meeting <br />concerning a previous request for a zoning change. <br />He stated he inspected previous documents and siext step, au a matter of <br />law, would be application to the Supreme Court if he couldn't convince <br />the Board. <br />Ue staled he wrote Zoning Officer on 4-19-73 reda:ding a proposed <br />Amusement park in Imperial Plaza with attached list of rides and he was <br />here to araange zoning. <br /> <br />Mr. 5ilberstein reported he received a letter ~rom Zoning O~ficer dated <br />4-2.5-73 stating, he could not issue a permit as it was not included under <br />the Zoning Ord. <br />lie stated he conceded Bd. o~ Trustees has power :o issue permits <br />permitted uses~ can impose conditions, but ~rmit has to be issued. <br />Hr. Silbezstein reported B~rd can issue permit acco~din9 to conditions <br />but there were no conditions in ordinance. <br />Ue stated Village cant impose conditions with ~he ope:a~io~ o~ a business <br />a~ the we:ding rpgulatlon was no~ the same as ptohlbition in a~*nded <br /> <br />Mr. 5ilbersteln~ discussed de~inltlon off a carnival and va:Sous Court <br />decisions laid do~n on above. <br /> <br />Atty. Lyons reported ¥illa~e Bd, couldn't digest all this in~ormatlon this <br />evening but most carnivals and fairs were travelling shows. <br />He staten amended Zoning Ord. makes uses more easily available and <br />Zoning Ord. makes provisions £or interpretatiot~s by 7~nlnu Bd. o£ A~)ealse <br /> <br />Tr. DiDomizio inquired if Mr. Seeber owned property in the area ind he <br />replied no. <br /> <br />Atty. Lyons reported normal procedure wou~d obtain lease before requesting <br />permit. He stated Village lld. would study iu£ormation £urther and analyze <br />material, <br /> <br /> <br />
