14 <br /> <br />A Public Healing on a proposed Local [.aw which would amend the provisions of <br />the Revised Zoning O~dinance of the Village with respect to gasoliue stations and <br />public garages was held on Wed., Dec. 11, 1974 at 7:O(1 PM in the American Legion <br />Hall. <br /> <br />Those present: Mayor Synnett, Tr. I)olan, Tr. DiBerto, Tr. Bain, Tr. $ilvestri, <br />Tr. Bslding, Tr. Short and Atty. Lyons. <br /> <br />Atty. Lyons read notice of Public Hr. as it appeared in the W. & S.Do News on <br />Dec. S, 1974. <br />He stated this would amend ordinance to allow gasoline stations in a Central <br />Business District, subject to a Special Permit. <br /> <br />Atty. Lyons discussed restriction under Section 4 which are as follows: <br /> <br />1. No such use shall be located within two hundred (200) ~eet of a school, play- <br />ground, park, hospital, nursing hone, church, theater, fire stations public <br />library or other public gathering place, unless a street fifty (50) feet or more <br />in width lies between such service station or garage and the uses above ene~erated. <br /> <br />2, No such use shall be located upon a lot having less than one hundred (100) <br />feet of frontage on a public street. If situate at an intersection, such lot <br />mast have at least one hundred (100) feet of frontage on one of such intersect- <br />ing streets. <br /> <br />3. No gasoline service station shall be located within three hundred (300) <br />feet of another gasoline service station or a public garage fronting on the <br />either side of the same street, and no public garage shall be located within <br />three hundred (3OO) feet of another ~ublic garage or a gasoline service station <br /> <br />frontin9 on the either of the same street. <br /> <br />4, Only access drives may encroach upon any requited yard areass and no park- <br />in9 or storage of motor vehicles in such areas shall be permitted. <br /> <br />5. No fuel pump shall be located within twenty (20) feet of any side lot line <br />or any street line, measured from the outside edge of the fuel island. <br /> <br />6. No sore that three (3) unregistered vehicles may be parked on the property, <br />and no dismantled or wrecked vehicles, shall be stored thereon, unless within <br />a buildin9. <br /> <br />7, All major repair works servicing, lubrication and car washing shall be <br />done within a oompietely enclosed building. <br /> <br />He stated Zoning Board shall have no authority to wavier any of the above <br />restrictions. <br /> <br />Mr. Russell Aldrich stated he was in favor of the proposed Local Law as <br />most gasoline stations were in non conforming use. <br /> <br /> <br />
