PUBLIC HEARING was held at 7:00 P.M. on July 14, 2004 for the purpose of <br />discussing Local Law #2, amending Section 148-25 Zoning Code allowing the Water <br />Board to set any and all fees applicable to their operation. <br /> <br />Mayor Lawrence stated the purpose of amending this Local Law is to allow the Water <br />Board, at their discretion, to change the fees as needed. This rate, the law will them to <br />change that. <br />It was asked how many times the fees/rates could be changed. Would it be a one-time <br />shot? <br />Mayor Lawrence stated the way it was before that it was a standard rate. The rates have <br />been changed since then but it was never justified in the Code. This time there will not <br />be a rate listed. If the Water Board wants to raise the rate in the future, they can. He is <br />not saying it is going to go up but it needs to be changed. He stated this was brought to <br />the Board's attention by the Building Inspector, Michael Witkowski. He then asked if <br />there were any other questions on water rates for the Village. <br /> <br />Bridget G-annon-Tyliszczak, 24 West Academy, Street, asked would the Water Board <br />have to ask the residents if they could raise it each time or is it a one time raise? <br />Mayor Lawrence stated he believed that if they wanted to raise the rates, they could do it. <br />Ms. Gannon-Tyliszczak then asked if they could raise the rates at any time and to any <br />amount? <br />Mayor Lawrence stated he believed they could. He said the Village Attorney would be <br />here shortly and he could answer that question but he believes this is the way it is. <br />Clerk Karge stated this Local Law Would not affect water rates. This is allowing the <br />Board of Commissioners, Mr. Schinella, Mr. Travis, and Mr. Momzzi. it's allowing them <br />to be able to change laws within their community, the Commission, by Resolution as they <br />see fit. Fees for a hook-up, fees for a disconnect, fees for an inspection, those are the <br />kind of things they can do. It has nothing to do with water rates. <br />They can do that on their own as they have in the past. This is allowing that Board the <br />flexibility to do it by Resolution without a Loml Law. <br />Clerk Karge then asked if there were any further questions about the Local Law. <br />He then asked for a motion to dose the hearing on the Local Law. <br /> <br />Motion by Tr. Marshall, seconded by Tr. Visentin to close hearing on Local Law #2. <br />All in favor. Canied. <br /> <br />Clerk Karge stated that there would be a Hearing on Local Law #3 for the year 2004. <br />It was stated that it was only 7:05 P.M. and the hearing is not scheduled until 7:15 P.M. <br />Clerk Karge stated they could wait ten minutes and informed the assembly that there is <br />quite a bit of reading. <br />Tr. Marshall suggested they move on. <br />Mayor Lawrence suggested they wait. <br />Discussion followed. <br />Mayor Lawrence then asked if anyone had any questions they would like to address to <br />the Board. <br /> <br /> <br />
