Public Hearing at 7:00 PM to discuss Local Law #3, 2004 amending Section 151 of the <br />zoning code so as to redefine those fees charged applicants for zoning permit. This is a <br />continuation of the Public Hearing on this topic on 7/14/2004. This Public Hearing was <br />held prior to the August 4, 2004 workshop meeting of the Village Board. <br />Village Clerk Karge was at class in Ithaca, so the meeting was conducted by Village <br />Treasurer Eisengruber. The workshops are not recorded and so this Public Hearing <br />was not recorded. <br /> <br />Attendees: Mayor Calvin Lawrence, Deputy Mayor Robert Juliano, Trustee John <br />Enson, Trustee Richard Cerino, Trustee Janice HIIderbrand, Trustee Robert Marshall, <br />Trustee John Visentin <br /> <br />Mayor Lawrence opened the discussion by commenting that this topic had been <br />discussed thoroughly at the last meeting. <br />Tr. Visentin respectfully suggested that the Board table this Public Hearing be tabled <br />until the Village attorney was present as he (and perhaps other, in the audience) had <br />questions requiring a legal opinion as part of the responsel <br />Tr. Juliano suggested that since the Building Inspector, Michael Witowski, was present <br />that the Public Hearing continue so we could bring out all the questions and Tr. Juliano <br />further indicated that no voting would take place tonight and agreed that further Public <br />Hearings on this subject would require the attendance of the Village attorney <br />Mayor Lawrence introduced Building Inspector Witowski to handle the questiOns on the <br />new fees. Mr. Witowski indicated that he had researched the fees by examining the <br />fees in surrounding municipalities. <br />Mr. George Kolb, current Building Inspector for the Town of Wappinger and previous <br />Village Building Inspector and Zoning Enforcement Officer, asked, "has this gone to <br />committee?" <br />Tr. Juliano responded that there had been several meetings. <br />Tr. Cerino indicated that he had attended 2 meetings and indicated that there was <br />some disagreement among the committee about the proposed law. <br />Mr. Kolb asked if this had changed since the last meeting. <br />Mr. Witowski indicated that the document was basically the same except for including <br />changes proposed from the floor last month and from the attorney. <br />Mr. Kolb asked if the attorney cOmments were made available to the Board and went on <br />to agree with Tr. Visentin that an attorney should be present since he had several <br />questions that required a legal opinion for a response. <br />Mr. Witowski indicated that the attorney is well aware of the changes. <br />Mr. Kolb asked if the attorney agreed that all the fees are legal. <br />Tr. Juliano suggested that we open the floor for comments from the audience. <br />Mr. Kolb indicated that he supported the recreation fee but questioned the fire fee. He <br />has no problem supplementing the money for the fire department but thought it should <br />be through the budget not through fees. <br />Mr. Kolb questioned the special meeting fees from the Planning Board and the Zoning <br />Board of Appeals.
