The Regularly Scheduled Meeting of the Mayor and Village Board of Trustees was <br />held on Wednesday, January 12, 2005 at the American Legion Hall, 7 Spring Street, <br />Wappingers Falls, New York 12590 <br /> <br />Meeting was called to order 7:30 P.M. <br /> <br />PLEDGE OF ALLEGIANCE. <br /> <br />MOMENT OF SILENCE was held in remembrance of the tsunami victims. <br /> <br />ROLL CALL: Mayor Lawrence, Deputy Mayor Juliano, Tr. Enson, Tr. Cerino, Tr. <br />Marshall, Tr. Hilderbrand, Tr. Visentin. All present. <br /> <br />ACTION ON MINUTES: December 8, 2004 & December 20, 2004. <br />Motion by Tr. Enson to accept minutes of both meetings as written. Seconded by Tr. <br />Cerino. All in favor. Carded. <br /> <br />AUTHORIZATION TO PAY BILLS AS PER APPROVED WARRANT. <br />Motion by Tr. Juliano to pay the bills audited as per approved Warrant. Seconded by Tr. <br />Cerino. Carded. <br /> <br />At this time the Clerk asked for a motion to go into Executive Session. <br />Motion by Tr. Juliano to go into Executive Session. Seconded by Tr. Marshall. Carded. <br />Executive Session 7:31 P.M. <br />Motion by Tr. Cerino to return to the regular meeting. Seconded by Tr. Enson. Carried. <br />Return to regular meeting 8:16 P.M. <br /> <br /> Anchor Pub: <br /> Carmine Carolei, Attorney for Doug Frye, addressed the Board. He stated they were at <br /> the workshop last week. He needs guidance from the Board what way they want to go. It <br /> was his understanding that a law was going to be amended. <br />Atty. Viglotti stated the Legislative Committee asked him to prepare a Local Law for <br />tonight's meeting. The law that was proposed would allow the Planning Board to do <br />away with off street parking if they felt there was sufficient on street parking. The law <br />requires off street parking. When the Legislative Committee discussed this with him, <br />what they were doing was giving the Planning Board the power that the Zoning. Board <br />would have and that is to give a variance for a reqUirement of the law. He wrote to the <br />applicant's attorney right before Christmas and told him after discussing this with the <br />Legislative Committee, it was thought a variance should be applied for. It looks like that <br />particular site doesn't have an issue with off street parking because there is sufficient <br />parking on street. The attorney called him. Evidently the application was not made. <br />Atty. Carolei stated they did not have enough time. <br />Atty. Viglotti stated he got the letter the day before Christmas and you had to apply. <br />Atty. Carolei stated he received the letter Tuesday of last week. When he got the letter is <br />irrelevant to him. They want to get this resolved. <br /> <br /> <br />
