MINUTES OF PLANNING BOARD -2- <br /> <br />6/1/06 <br /> <br />reminded that a letter fzom the Village Attorney regarding any liability to the Village <br />must be documented with the Planning Board files. Mr. Morals stated as far as screening <br />was concerned - on the drawing there were some bushes that were encroaching onto the <br />neighbors property - he suggested applicant assure that all screening is entirely on his <br />property. Mr. Paggi read and reviewed his comment letter dated May 31, 2006 (copy on <br />file in the Planning/Zoning offices). Mr. Alfonso reminded the Board that Mr. <br />Delehanty (neighbor) had done the same thing with his parking lot and applicant <br />answered he was aware of it - and that he had a smaller parking lot with more drywells. <br />At this point Mr. Moran made a motion to approve the improvements to the parking lot <br />contingent upon: (1) screening not encroaching on neighbor's property and (2) slope to <br />be as minimal as possible and (3) letter from Village Attorney Viglotti stating the Village <br />is not liable for any of the runoffto the sidewalk. Motion was seconded by Mr. Alfonso. <br />Unanimously carried. <br /> <br />The sign was discussed next. Applicant was instructed to bring in a color chip for the <br />files. The san~ple number of the color as #1302. It was stated that the monument sign <br />would be the only sign on the property. The application was reviewed for conformance <br />to the codes. It was stated that the sign would be located in the same location as the <br />previous sign and the lighting would be the same (there would be no overflow lighting <br />onto neighbors properties)- the lighting would be incorporated into a landscaped bed <br />below the sign. Mr. McCormick made a motion to approve the sign as presented <br />contingent upon applicant supplying the Board with a color chip, motion was seconded <br />by Mr. Moran. Unanimously carried. <br /> <br /> DUTCHESS SHOPPING PLAZA~ ROUTE 9 <br />Next on the agenda was the proposal from Dutchess Shopping Plaza for a sign. It was <br />stated that there is a problem with parking in the plaza. Applicant presented the Board <br />with a letter from plaza owners stating she had their permission to represent them. There <br />is currently a pole with a sign on it that states no parking from here to end of plaza and <br />the business owners on the other end of the plaza would like the same consideration. <br />They would like a sign approximately 24" x 16" that reads - "No parking in between <br />signs after 6:00 p.m. unless a customer of the plaza - violators will be towed at owners <br />expense." The sign would be mounted to brick wall. Mr. Morris reminded applicant <br />that they would have to bring in a sample of the red (sign will be white with red letters). <br />Mr. Morris also suggested applicants check with their attorney before they letter the sign <br />to make sure they are on firm ground in the plaza. Applicant also asked if they could put <br />up a temporary banner on the road sign advertising empty store fronts in the plaza. Mr. <br />Morris stated that temporary banners were under the prevue of the Code Enforcement <br />Officer.
