MINUTES OF PLANNING BOARD -2- <br /> <br />1/8/04 <br /> <br />his business. The sign was reviewed next. Applicant stated the sign he is proposing <br />would actually measure 3' x 5'. It would be emerald green with white lettering. <br />Applicant was instructed to supply the Board with exact color samples for the sign. It <br />would be placed perpendicular in the front yard - and be two sided. Again it was stated <br />that the he had the owner's consent. It was then stated that applicant was proposing that <br />the sign would be 7 ft. tall. He stated that the fence is 4 ft. and he wanted to be able to <br />see sign above fence. It was stated that since the sign is 3 feet tall - the bottom of the <br />sign should be no higher than the top of the fence. It was further stated that the sign <br />would be down lit - and applicant was instructed to keep the wattage low. It was stated <br />that the use is an allowed use and that the parking is conforming to code. Again he stated <br />that his hours of operation would be from 9:00 a.m. to 9:00 p.m. - Monday through <br />Saturday. Applicant was informed that if he intended to expand on his hours or days of <br />operation he would have to come back to the Planning Board. Mr. Moran made a motion <br />to approve the use, seconded by Mr. Alfonso. Unanimously carried. Next they voted on <br />the sign - Mr. Alfonso made a motion to approve the sign contingent upon: (1) color <br />chips being provided, (2) the bottom of the sign would be no higher than the top of the <br />fence, (3)it would be down lit and the wattage would be kept as low as possible. Motion <br />seconded by Mr. Moran. Unanimously carried. <br /> <br />ZIPPARO ENTERPRISES, INC. DUTCHESS SHOPPING PLAZA <br />Next on the agenda was the informal appearance by Zipparo Enterprises, Inc. to discuss <br />nightclub and cabaret at the Dutchess Shopping Plaza. Applicant stated that they would <br />like to operate an upscale nightclub. He stated that the last owners left the club in perfect <br />shape - therefore there would be no interior renovations. They would like to be open on <br />Thursday, Friday and Saturday from 9:00 p.m. to 4:00 a,m. - with Wednesday pre- <br />approved for a future time. There would be the same police presence as the previous <br />owners. He stated that he would have a dress code - which they will use as a tool to have <br />discretion. Their primary music would be from a DJ but they may have some secondary <br />acts. He also stated there would be absolutely no pyrotechnics. The Board also wanted <br />to clarify the definition of cabaret. Applicant stated in other counties you needed a <br />cabaret license and he thought he needed to be specific on this. There would be no type <br />of adult entertainment. Mr. Alfonso made a motion to accept the application to replace 9 <br />North and/or Club Illusions with Dreams based on this evenings presentation including <br />the days and hours outlined - seconded by Mr. Moran. Unanimously carried. At this <br />point the applicant took the word "cabaret" from the application and initialed it. <br /> <br />JULIANO ENTERPRISES, D/B/A SACIIDABOS, 2776 WEST MAIN STREET <br />Next on the agenda was a discussion regarding updated site plan and amended drawings <br />for Juliano Enterprises for their proposed restaurant at 2776 West Main Street. <br />Applicant stated that the issues that needed to be taken care of were the: (1) additional <br />building permit fee (at this point Mr. Flower stated that he had been working with Mr. <br />Juliano on the additional fee and this would be mitigated by the next day), (2) that <br />Planning Board approval must be obtained (Mr. Morris interjected that was what we were <br /> <br /> <br />
