MINUTES OF PLANNING BOARD -2-

1/4/01

cleared up. Motion was seconded by Mr. Alfonso. All ayes. Mr. Visentin asked if
applicant had addressed the parking situation for this building. He went on to state that
there are 15 spots designated in the municipal lot for all of the buildings that were
originally owned by Mr. Klebe. Does applicant have an agreement with the owner of the
other parts of the building that he will be able to use the 15 reserved spots? Mr. Visentin
went on to state that the Klebe's transferred the parking lot to the Businessmen's
Association and the Businessmen's Association allowed them to keep 15 spots for the
apartments.

JEROD PACILLI, 2 FULTON STREET
Next on the agenda was the request from the Board of Trustees that the curb cut at 2
Fulton Street be revisited The Board of Trustees does not feel that this curb cut
conforms to the original request and have not granted approval for it. The Board of
Trustees has received no approval from the Highway Superintendent. Mr. Karge stated
he is very familiar with the area and after looking at the plan Mr. Pacilli submitted and
the statement that he needed the additional parking to alleviate some of the congestion on
the other side of the building. It was stated that the Planning Board had sent a
recommendation to the Village Board of Trastees for their review. Mr. Pacilli was
under the understanding that he had approval and went ahead and pat in the curb
cut/driveway. The curb cut/driveway is not 18' x 18' as proposed it is smaller and he has
a solid fence which makes visibility dangerous. Mr. Pacilli also had stated he would be
using this driveway for his tenants and now he is saying he will be using it for visitors.
Mr. Karge stated he feels the curb cut/driveway should be ripped out. Mr. Alfonso made
a motion to have the Zoning Enforcement Officer issue a cease and desist on the
driveway/curb cut until all approvals are in place. Motion seconded by Mr. Karge.
Unanimously carried.

BOTT1NI CASEt CLINTON STREET AND WEST MAIN STREET
Next on the agenda was the proposal regarding site plans for Bottini proposals for their
properties at 18 Clinton Street and West Main Street. Ms Van Tayl who is representing
the Village stated the reason why this matter is before the Planning Board is because the
applicant and the Village are attempting to resolve differences relating to the use of the
Clinton Street site and we are exploring the possibility of amending the site plan that the
Planning Board previously approved in 1990for the West Main Street site - not by
changing anything on the plan except to designate the./ire lane - but mainly to modify
some of the special notes that were on that site platt At the same time there is now a
proposal for the Clinton Street that would set forth the uses that are on the property as
well as setting forth notes limiting the uses that can take place on that property as well as
designate the location of the parking spaces that are on the Clinton Street site to serve
the West Main Street site platt In November both of the site plans were discussed There
are now revised site plans submitted for both of the sites in conjunction with the
November meeting comments. Ms. Van Tuyl prepared a comment memo dated January
4, 2001 which was reviewed by the Board (A copy of this memo follows these minutes
and is also on ftle in the Planning/Zoning offices). She suggested a note be put on the
