Unanimously carried. <br /> <br />MARKET STREET INDUSTRIAL PARK-STABILIZATION OF SLOPE <br /> <br />Next on the agenda was an informal appearance by representative of Mr. Fedigan <br />regarding the stabilization of the slope. Mrs. Townsendpresented to the Board a copy of <br />a proposed maintenance agreement. Mr. Visentin stated the Village Attorney would have <br />to review the agreement. Mrs. Townsend then stated she had permission from one of the <br />landowners giving applicant permission to access through their land. They also had a <br />verbal consent from the other landowner (Mr. Palumbo). She went on to state that <br />actually what she needed would be an easement agreement with both landowners. The <br />applicant stated that the work being performed would not stabilization the slope. What it <br />would do would be to protect the applicant's building. Mr. Visentin stated that the <br />applicant would have to come back to the next meeting. Mr. Bricklemaier stated he <br />would be looking for certification stating that after the burm is installed future buildings <br />would be protected from the slope. <br /> <br />HEART KIA~ ROUTE 9 AND LISS ROAD <br />Next on the agenda was the proposal for Heart Kia Car Dealership for a proposed <br />used/new car lot at the intersection of Route 9 and Liss Road. It was stated that this was <br />a continuation ofapublic hearing. A memo from the Dutchess CountyDept. of Planning <br />dated April 6, 2000 was discussed. Applicant stated they had obtained a use variance <br />from the ZBA. The other issue from the County was landscaping and they have added <br />areas of landscaping in the front parking area and also in the rear parking area and now <br />have the 5% as recommended by the County. It was noted that pines would be planted <br />between Liss Road and the fence and the storm drainage system was discussed. <br />Applicant stated he had met with a representative of DOT on the site and they do need a <br />permit from them for construction and the DOT representative stated he did not see any <br />reason whey this would not be granted Applicant also talked about the type of separator <br />they would be using. All snow would be plowed to the north end portion of the parking <br />lot. Applicant provided a coloring rendering of the new building. Applicant was <br />reminded he could only have two signs for each unit of occupancy. <br /> <br />Mr. Morris made a motion declaring the Planning Board Lead Agency, seconded by Mr. <br />Alfonso. On roll call vote- Mr. Morris- Aye, Mr. Alfonso- Aye, Mr. Consentino - Aye, <br />Mr. Karge - Aye and Mr. Visentin - Aye. Mr. Visentin went on to state that having <br />reviewed the EAF and site plan and any and all changes made to the 'site are for <br />improvement purposes only, having duly reviewed the impacts to the environment and the <br />surrounding areas and required mitigation as the Planning Board has seen fit he would <br />like to have someone declare a negative declaration for the site. Mr. Morris made a <br />motion to declare a negative declaration for the project, seconded by Mr. Alfonso.
