A Public Heariu~ on a proposed local law entitled "A local la~ ame~ Section 310 <br />of the Zoning Ordinance and the Zoning MAp of the Village of Wappingers Falls, N.Y. (Spec- <br />ifically, the property owned by St~phe=n and Ellen seaman located at 38 South Avenue, frc~ <br />R-7.5 to Neighborhood Business, N.B.) was held on Wednesday, December 8, 1993 at 7:00 P.M. <br />in the Village Hall. <br /> <br />Present: Mayor Hinzmann, Tr. Napoleon, Tr. Shay, Tr. Traver, Tr. Ba~n, Tr. Usavich <br />and Atty. Vilgotti. <br /> <br />Atty. Viglotti read text of proposed law and reported property w~s zoned R'7.5, <br />although it h~asn't recently ~c~n used for residential purposes. <br />He stated structure had ~.~n destroyed by fire and ZoD2ing code requires any non- <br />conforming use of a building, where same is ~.~aged more than 50% of its m~ket <br />value, must rivert back to a conforming use. <br />He stated owner is now requesting property be rezoned N.B., which could allow profess- <br />ional offices or retail. <br /> <br />Tr. Napoleon inquired if a technicality existed whereby they could again sell cars, <br />being there was one existing building on the property. <br /> <br />Atty. Viglotti reported remaining building in front oould probably continue as <br />Oh~rcial. <br /> <br />Discussion followed on the previous uses of this property. <br /> <br />Atty. Viglotti reported Dutchess County Planning Board has sent their rec~,,~ndations <br />a~x~ stated they w~re concerned with Spot zoning. <br /> <br />Tr. Bain reported zoning mp, with ail its changes, has bec(m~ snarled and we <br />previously had t~o Master plans prepared, but never fully adopted, because they <br />were never ~_rsued. <br />He stated that, if the present trend continues, the R-7.5 zone in this Village will <br />be eliminated. <br /> <br />Discussion followed on grandfathered properties in the Village and their effect on <br />the Zoning la~s. <br /> <br />Tr. Shay rec~,'~'~nd_~d we keep the antiquity of the Village and retail r~n in the <br />Business section along East Main Street. <br /> <br />Tr. Bain reported he saw no objection to the change should the Seaman's submit a <br />detailed specific plan which was conducive to the neighborhood but excluded uses <br />in the proposed law were too negative. <br /> <br />Neither the Seaman's or a representative present at Hearing to e~press tt~ir opinion <br />and Atty. Viglotti reported Hearing has been extended an addition~]_ 15 minutes. <br /> <br />He stated Village Board could delay zoning change request until a specific site plan <br />is presented. <br /> <br />Public Hearing adjourned until a later date. 7:30 P.M. <br /> <br />Maria Gilbride <br /> <br /> <br />
