MINUTES OF PLANNING BOARD -2- 4/5/07

Wool Coat for the building and Behr C70-33 Pyramid for the trim (color samples are on file in the
Planning and Zoning offices). The five doors on the building would be painted the same color as the
trim. Mr. Kolb made a motion to approve the colors for the building seconded by Mr. McCormick.
Unanimously carried.

Next the lighting was discussed. Mr. Fulton stated they would be installing the lights under the peaks
on the west, east and north sides of the building. Mr. Fulton was reminded to be consistent with the
Village's new lighting law. Mr. Morris stated he would like a sketch of where the lights would be
installed for our records to assure that the lighting is contained only on the park property and does not
spray to neighboring houses. Mr. Kolb made a motion to approve the lighting contingent upon Mr.
Fulton supplying the sketch to the Planning Office. Motion was seconded by Mr. McCormick.
Unanimously carried.

HIP HOP SENSATION, 2554 SOUTH AVENUE
Next on the agenda was the application of Hip Hop Sensation for a new sign at 2554 South Avenue.
Mr. Simmons the owner of the store stated he would like to install a a banner type sign on two posts on
the front lawn of the store facing Route 9D. He stated he had one previously and it generated more
business for him and since he took it down he has seen a decrease in his sales. Both Mr. McCormick
and Mr. Kolb stated they were not in favor of a permanent banner type of sign – aesthetically it would
not be pleasing and the Board has spent a lot of time on the new ordinances and it would violate those
new ordinances and they are also concerned it may start a precedence with other businesses. One of
his alternatives would be to take down the sign on the front of the building and add another type of sign
to the road sign but he would have to go back to the Planning Board for approvals. He could also apply
for another temporary sign to hold him over until he gets approval for a more permanent sign – he
would have to work with the Code Enforcement Officer for this. Mr. Morris suggested Mr. Simmons
get a copy of the new law regarding signs.

STRAUB FUNERAL HOME, 55 EAST MAIN STREET
Next on the agenda was the application of Straub Funeral Home for a new sign at 55 East Main Street.
Ms. Catalano one of the owners of the funeral home was present. Mr. Morris stated he liked the sign
itself but felt it was too large. Ms. Greig stated the sign should be reviewed against the new sign law.
Mr. Kolb asked if the sign company could computer generate a sketch to show what the sign would
look like against the building. Mr. Morris read from the new sign laws to give Ms. Catalano an idea of
what type of sign should could legally have. Ms. Catalano stated she had a copy of the previous sign
law and was not aware that there was a new sign law in effect. Mr. Kolb stated that Ms. Catalano was
right in between the old ordinances and the new laws being passed. It was suggested that Ms. Catalano
get a copy of the new ordinances and come back next month with a sign that is more in compliance
with the ordinances.

UNITED METHODIST CHURCH, 9 SOUTH MESIER AVENUE
Next on the agenda was the application of United Methodist Church for a new sign at 9 South Mesier
Avenue. Mr. Gioia was representing the Church. He was informed that when the new sign ordinance
was filed in Albany all signs would have a three year window to come into conformance. His new sign
was reviewed by the Board – he stated it would have two spotlights. Mr. McCormick made a motion to
approve the sign as presented contingent upon the Code Enforcement Officer confirming that the
lighting does not spill onto neighboring properties and to verify the sign would not obstruct vision of
drivers coming out of South Mesier Avenue. Motion was seconded by Mr. Kolb. On roll call vote –
