<br />MINUTES OF ZONING BOARD OF APPEALS MEETING HELD 5/6/08 <br /> <br />Present: Lloyd Frink, Chairman, Frank Barresi, Vice Chairman, Allen Firstenberg, George <br />Dansereau, Richard Berube and Mary Ann Loncto, Secretary <br /> <br />Absent: Scott Davis <br /> <br />Others Present: <br /> Dave Webber Lou Kaufman <br /> Susan Fasnacht Jim Horan <br /> Craig O'Donnell <br /> <br />Meeting was called to order at 7:30 p.m. Secretary took roll call – Mr. Davis was absent. <br />Mr. Frink welcomed Mr. Richard Berube as the alternate to the Board and hoped that he found his <br />experience with the Board interesting and engaging. <br /> <br />WENLISS TERRACE/STUART AVENUE – DUTCHESS LANDING, LLC <br />First on the agenda was the public hearing on the request of Dutchess Landing, LLC, 241 Hudson <br />Street, Hackensack, NJ seeking the following area variances to be able to subdivide 12 existing lots at <br />Wenliss Terrace/Stuart Avenue. (Copy of public hearing notice is attached to these minutes). <br />Applicant presented proof to the Board that all Legal Notices to property owners within 250 ft. were <br />notified and that the legal notice was published in the April 26, 2008 edition of the Poughkeepsie <br />Journal. Secretary stated that Dutchess County Department of Planning had responded to the zoning <br />referral with a “matter of local concern” comment. Mr. Frink asked if there was anyone in the <br />audience who would like to speak at this time and no one answered. He went on to say that there are <br />12 lots and each lot has at least one variance with it – he would like to just have one hearing that takes <br />on the totality of all 12 lots instead of having 12 individual hearings. No one from the Board objected. <br />Mr. Frink also stated he would like to dispense with the reading of the legal notice – it is quite lengthy <br />and he would like the written copy to serve as the record. No one from the Board objected. <br /> <br />Mr. Kaufman representing the owners of Dutchess Landing LLC stated that he has come tonight to <br />request a subdivision of 12 lots on Wenliss Terrace/Stuart Avenue. There are two connected town <br />houses on each lot – he would like to ask the Board to basically draw a line down the middle of each lot <br />– straight through the middle of each building so that there would be 24 lots with a one family home on <br />each lot. In order to accomplish this – the applicants need variances for each lot. Each lot would need <br />a sideyard variance as there is no sideyard on the common wall. The second common variance that <br />each lot has is they do not meet the 10,000 sq. ft. minimum lot size. Each of the 12 lots also have other <br />area variances that are needed. Mr. Kaufman went on to state that the variances do not change the <br />physical, environmental, visual or uses for the homes on the lots – each resident could own their own <br />home and the benefits of home ownership is that there is a pride of ownership in the quality of your <br />care taking is enhanced typically by the person who owns rather than rents – there would be no <br />absentee ownership. The subdivision was created out of the existing homes on Wenliss Terrace/Stuart <br />Avenue and they are all individually owned. <br /> <br />Mr. Kaufman showed the Board a copy of a map of the original development that was created in 1955. <br />Mr. Kaufman stated he has a letter dated March 14, 2008 (copy of letter on file in the Planning/Zoning <br />offices) from Paggi, Martin and DelBene stating that he has pulled copies of Filed Map #2601 from the <br />County Clerk's Office website and also the aerial map for the same area – both maps consistently <br />showed that the lots are subdivided into individual properties with a common property line down the <br /> <br />
