Spec/al meeting was held on 11-14-86 at 7:00 P.M. <br /> <br />Present: Tr. Greco, Tr. Alfonso, Tr. Komornik, Tr. Schinella, Tr. Todaro, <br />and Atty. Viglotti. <br /> <br />The following resolution was duly moved by Tr. Schinella, seconded by Tr. <br />Greco: <br /> <br /> WHeReAS , th~;'~illage of Wappingers Falls is a participant in the <br />Tri-Municipal Sewer Improvement Area, and <br /> <br /> WHEREASt a draft of a proposed Sewer Use Ordin~ace and a draft of a <br />proposed Schedule of Sewer Rental Rates and User Fees have been proposed <br />for approval by the Village of Wappingers Falls~ and <br /> <br /> WHEREAS, said draft of proposed Sewer Ordinance having been condit- <br />ionally approved by the New York State Department of Environmental <br />Conservation on June 22, 19841 <br /> <br />NOW~ THEREFORE, be it <br /> <br /> RESOLVED that the draft of the Tri-Municipal Sewer Improvement Area <br />Rental Rates and User Fees as attached hereto be approved as the form <br />of the Sewer Use Ordinance,_. be it further <br /> <br /> RESOLVED that the draft of the Tri-Municipal Sewer Improvement Area <br />Sewer Rental Rates and User Fees as attached hereto be approved as the <br />form for the Sewer Rental Rates and User Fees to be charged. <br /> <br />Resolution unanimously adopted. <br /> <br />~ESOLUTION <br /> <br /> WHEREAS by Section 352-e) 2-a of the General Business LaM of the <br />State of New York, local municiplaities have an option to provide <br />for regulation of rental units in buildings subject to or which are <br />being converted to either condominiums and cooperatives, and <br /> <br /> WHEREAS, the Village Board of the Vi llage of Wappingers Falls <br />wishes to exercise the local option provided in said law~ <br /> <br /> NOW, THEREFORE, on the motion of Trustee Greco, seconded by Trustee <br />Alfonso <br /> <br /> BE IT RESOLVED that any non-purchasing tenant who is either an <br />eligible senior citizen or aneligible disabled person as defined by <br />Section 352-e) 2-a of the General Business law of the State of New <br />York who is an occupant of a building or structure for which conversion <br />is sought from residential rental status to cooperative or condominium <br />ownership shall not , either prior to or subsequent to said conversion <br />be subject to removal from units occupied by them prioXo said conversion <br />unless a proceeding is commenced against said tenant for either (1) <br />non-payment, of rent, (2) illegal use mr occupancy of the premises, <br />(3) refusal of reasonable access to the owner, and <br /> <br /> <br />
