A Public Hearing regarding proposed Local Law #6 of 1992 p~_rtaining <br />to the enforcem~nt of the NYS uniform Building and Fire Code w~s held on <br />Wednesday, July 8, 1992 at 7:15p.m. at the Village offices in the <br />AT~rican Legion Hall on Spring Street. <br /> <br /> Present: _Mayor Hinzmann, Trustees Bain, DiDc~zio, Kcmornik, <br />Napoleon, Shiny, and Usavich; also present Att'y Viglotti. <br /> <br /> Mayor Hinzmann opened the Public Hearing and requested Attorney <br />Viglotti give a brief precis of the proposed law. <br /> <br /> Attorney Viglotti explained that while tb~ Village had adnpted <br />the NYS Unifonn Code, the code itself mentioned prohibited activities <br />but did not specifically address penal~. <br /> He further explained that for example, Section 3 of L.L.#3 describes <br />the penalties for violation of the Uniform Code or failure to cu¥~ly with <br />an Order to Correct issued by the enfocement personnel; that Section 4 <br />authorizes the Village to seek injunctive relief; and Section 5 delineates <br />who has the authority to issue appearance tickets for alleged violations. <br /> He clarified that this proposed local law is specific to the enforc~mlent <br />of the State Unifom Code. <br /> <br /> Tr.Bain said that the Board still r~ed to address th~ quest/on of <br />enforcement jurisdiction on general local laws and ordinances. <br /> <br /> Attorney Viglotti explained that technically the police were the <br />"fall-back" mechanism for law enforc~nent. <br /> <br /> Tr. Bain sta*ed that the police had not been advised of the adoption <br />of regulations regarding the use of the Lake. <br /> <br /> The Mayor stated that it would be advisable to forward copies of local <br />laws to the department as nM ones are adopted. <br /> <br /> Tr. Kcmornik stated that tb~ police cannot enforce laws unless they <br />receive notice of their adoption. <br /> <br /> There b~ing no fttrther cu~B,~nt on proposed L.L.#3 of 1992; the <br />Public Hearing on same was closed at 7:30 p.m. <br /> <br /> <br />
