A Public Hearing regarding the renewal of the US Cablevision Franchise, with <br />partic lar attention to the adoption of a ten year contract was held on <br />Janual~! 13, 1993 at 7~00 <br /> <br />Present: .Ma~vor Hinzmann~ Tr. Napoleon Tr D~zio~ Tr. S~hay, Tr. Bain, Tr. <br />Usavich and Atty. Viglotti. (Tr. Kcmornik absent due to illf~ess) <br /> <br />Atty. Viglotti reuorted purgose of the hearing was to ans~er any questions <br />concerning the proposed contract which has been reviewed lyf the Village Board <br />at previous ~tings and revisions have been made. <br /> <br />~qt. Joshua Koenig, Atty. for US Cablevision Cor~. > present to resoond to any <br />inquiries .per~ining to contract. <br /> <br />~ir. Koenig reported there were no major changes and prooosal was of the s~ne <br />text as was being p~sued by our neighboring munic ioalities. <br />He said several changes have ~cm cc~oromised, following analysis of the <br />oroDosed ~Dntract by Counsel for the Co~mission on Cab!evision, and, where <br />merited, have been incoroorated. <br /> <br />Atty. Viglotti discussed Section 7 of the contract relating to Franchise f~s <br />whereby the Village shall received 5% of the (k~Noany's gross re0simts eah <br />year ~ less any ~m~unt due NYSCCT for the same -°cried. <br /> <br />~ir. Ko~anig reported the present contract, now in effect, does not allow Village <br />the full limit which is 5% and this oercentage~ included in the oroposal, is - <br />based on all the receipts relatige to the operation of the syst~ within the <br />Village. <br />He disc ussed other costs incurred by CATV which were mandated by various <br />govermmm~t agencies. <br /> <br />Tr. Nanoleon inquired if Village was satisfied with the revised copy of this <br />contract and Atty. Viglotti stated we should authorize the enactment of the <br />prooosa~ dated 12-1-92. <br /> <br />Tr. Naooleon re.ported subscribers were, in effect, paying a Portion of the <br />franchise fee, as same is made by Dart of their monthly billing. <br />He said he ~asn't ha .o0y with this oolicy_. <br /> <br />Mr. Koenig rer, orted orice of CATV service reflects all the charges and they <br />can list the c~onent price on the bill, whichis fullv lawful. <br />He stated they will cu~oly with State regulations. <br /> <br />Discussion followed on the various ootions and the selection of d_~nnnel pro- <br />gramming pertaining to same. <br /> <br />>~r. Koenig reoorted that, with new Federal regulations, municipalities may <br />have more control over oricing and selection aD~ discussed these controls along <br />with ~rogram~ng and the re-structuring of the system. <br /> <br />Atty. Viglotti re~orted that, in conjunction with the execution of the contract, <br /> the Mayor should be authoriZed to sign a release which will orov~e Village <br />with $25,000 in back franchise fees for the years 1989 to 1992. <br /> <br />No one present voiced a cc~nent pro or con on said contract. <br /> <br />Public Hearing closed. 7:30 P,Y{. <br /> <br /> <br />
