<br />Minutes following the 01/14/09 Village Board Meeting <br /> <br />1/14/2009 <br />“PCPP.T-Y”. <br />LEASE TURN OFF ELL HONES AND AGERS PRIOR TO START OF MEETING HANKOU <br /> <br />Continuation of Public Hearing from 12/10/08 <br />C <br />LERK READS PUBLIC HEARING NOTICE <br /> <br />NOTICE IS HEREBY GIVEN <br /> that the Board of Trustees of the Village of Wappingers <br />th <br />Falls will conduct a PUBLIC HEARING on the 10 day of December, 2008, at 7:00 p.m. <br />at the American Legion Hall, 7 Spring Street, Wappingers Falls, New York, at which <br />time all parties in interest and citizens shall have an opportunity to be heard as to whether <br />the Board of Trustees of the Village of Wappingers Falls shall adopt a proposed Local <br />Local Law No. 9 <br />Law entitled " of the Year 2008, Establishing a Building Rental Permit <br />and Process for the Village of Wappingers Falls.” <br /> <br />T <br />HE CHAIR DECLARES THE CONTINUATION OPEN <br /> <br />C <br />LERK READ PUBLIC HEARING NOTICE <br /> <br />Mr. Hanig of Hanig , Handel & Schutzman, Attorneys at Law, LLP addressed the Board <br />saying he was representing Redhead Properties, LLC with respect to the proposed local <br />law #9. Mr. Hanig pointed out several areas of concern more specifically the area of <br />tenants being allowed to withhold lease or rental payments for failure on the part of the <br />property owner to remedy a violation resulting from a defect reported. Attorney Viglotti <br />said the Board would consider rewording that section to be more in line with a condition <br />which rendered the dwelling inhabitable. There was also a concern pointed out about a <br />agent being named who resided within Dutchess County who would be a contact source <br />for the property owner who did not reside within the county. Trustee Cerino said he <br />would support a change to that section of which would be a 25 mile radius as apposed to <br />within Dutchess County. Further comments from the Board (Trustee Italiano) said he had <br />received several concern from residents about the validity of the proposed law over all. <br />Few residents also had questions about who would be inspected? Attorney Viglotti again <br />pointed out that only those one and two family rental units which were not owner <br />occupied.Motion by Trustee Marshal to close the Public Hearing. Seconded by Trustee <br />Calabrese. Carried.
