<br />MINUTES OF ZONING BOARD OF APPEALS MEETING HELD DECEMBER 9, 2008 <br /> <br />Present: Lloyd Frink, Chairman, Scott Davis, Allen Firstenberg, George Dansereau and <br /> Mary Ann Loncto, Secretary <br /> <br />Absent: Frank Barresi <br /> <br />Others Present: Jim Horan Mark Parrella <br /> John Adams Patrick Tandy <br /> John Fenton <br /> <br />Meeting was called to order at 7:30 p.m. Clerk took roll call – it was noted that Mr. Barresi was <br />absent. <br /> <br />CASTLE ROCK BUILDERS, 22 WEST ACADEMY STREET <br /> <br />First no the agenda was the public hearing on the request of Castle Rock Builders, 22 West Academy <br />Street, seeking the following area variances from Section 151-16(A) to be able to construct a single <br />family house at 7 Dutchess Avenue (1) required side setback is 10 feet and you only have 4 feet on the <br />south side, (2) required lot size is 10,000 sq. ft. and you only have 3,936 sq. ft. and (3) required lot <br />width is 75 ft. and you only have 32 ft. in the rear and 36 ft. in the front at 7 Dutchess Avenue. Mr. <br />Mark Parrella stated he is the owner of the lot at 7 Dutchess Avenue. He submitted his affidavit of <br />publication and proof of legal notice mailing. Secretary stated that Dutchess County Dept. of Planning <br />had responded to the legal notice with a “matter of local concern” comment. <br /> <br />Mr. Parrella stated the former house was a duplex house that burned down. The duplex was actually <br />individually owned – one owner for each lot. The owner of 5 Dutchess Avenue built a single family <br />house on their lot and Mr. Pararella would like to do the same. He stated instead of having a vacant <br />lot in the middle of a residential neighborhood – there would be a nice, single family residence there. <br />He stated he is a Village resident – it would be easy for him to work on it – the house would be 1500 <br />sq. ft. - 3 bedrooms with 1 ½ bath - with off street parking. He stated he has a two year financing from <br />the previous owner so he needs to get this done within two years. He stated if he does not get the house <br />done in two years – he would just abandon it. His total tax levy is $830.00. Mr. Frink asked Mr. <br />Parrella how he arrived at the 4 ft. setback and he stated with having a driveway he tried to make the <br />house as wide as he could and this fit the pattern. Mr. Frink stated he was on the Board at the time that <br />5 Dutchess Avenue came for area variances to build a single family house and a 2 ft. sideyard variance <br />was granted. It was stated at that time if the owner of the adjacent lot ever came for a variance – then <br />the ZBA would be agreeable to issuing a 2 ft. sideyard variance. He stated that he did not plan on <br />paving on the driveway – he would just grade it and put down Item #4 gravel. Mr. Fristenberg asked <br />Mr. Parrella if he would be agreeable to changing the outside of the house to mirror the house at 5 <br />Dutchess Avenue – to make it look like a duplex that is just pulled apart and he answered he would be <br />agreeable to look into it and see what he could do. He also stated that there would be a full unfinished <br />basement. <br /> <br />Mr. Firstenberg made a motion to close the public hearing, seconded by Mr. Davis. On roll call vote – <br />Mr. Firstenberg – Aye, Mr. Dansereau – Aye, Mr. Davis – Aye and Mr. Frink – Aye. <br /> <br />IMPERIAL PLAZA, ROUTE 9 <br />Next on the agenda is the public hearing on the request of Imperial Improvements, LLC 500 White <br />Plains Road, Tarrytown, NY seeking the following area variances to be able to have more signage than <br /> <br />
