<br /> <br />MINUTES OF THE ZONING BOARD OF APPEALS MEETING HELD APRIL 7, <br />2009 <br /> <br />Present: Lloyd Frink, Chairman, Frank Barresi, Allen Firstenberg, Kristina Costa, <br />Jim Horan, Attorney <br /> <br />Absent: Scott Davis <br /> <br />Others Present: Al Cappelli Nancy Bostwick <br /> Bill Bostwick Mike Berta <br /> <br />Meeting was called to order at 7:30 p.m. Mr. Frink welcomed Ms. Costa to the Zoning <br />Board of Appeals. <br /> <br />MARK RENNHACK, 787 OLD ROUTE 9 <br />First on the agenda was the request of Mark and Brian Rennhack, P. O. Box 89, <br />Hopewell Junction, NY 12533 seeking an area variance from the parking requirements - <br />required is 27 spaces and existing is 21 spaces with an additional five needed for pro- <br />Posed office space on the second floor of the building at 787 Old Route 9. Secretary <br />stated that Dutchess County Department of Planning had responded to the zoning <br />referral with a “matter of local concern” comment. Mr. Cappelli representing the <br />applicants handed in his legal notice which was published in the March 24, 2009 edition <br />of the Poughkeepsie Journal and copies of mailings of his legal notice. <br /> <br />Mr. Cappelli stated that the building was constructed five years ago - the site plan was <br />brought to the Planning Board simultaneously with an adjacent property owned by the <br />Bostwicks. The building did not have enough parking - when they went to the Planning <br />Board - the Planning Board approved the site plan without sufficient parking because of <br />the cross over easements and parking easement that they are sharing with the adjacent <br />property owner and likewise he has access onto the Rennhacks property for parking. The <br />building is a 2 ½ story building - the owner is looking to put his offices in the attic <br />portion of the building - there is currently a single tenant in the building - it is a business <br />that calibrates surveying and engineering equipment. They currently have 6 employees. <br />They utilize 4-5 parking spaces at most - on a daily basis. The original intent of the <br />building is that the Rennhacks are in the swimming pool business - they were going to <br />take the second floor to sell swimming pool equipment and supplies to facilitate their <br />business - the first floor was going to be rented and then the Engineering company came <br />in and rented the first and second floor. The intent is not to have a retail operation in the <br />attic - just offices for the owner to operate his business which is a swimming pool <br />business. The Rennhacks will only be utilizing 1 to 2 parking spaces. They went to the <br />Planning Board who referred them to the ZBA for the parking variance. <br /> <br />Mr. Frink asked if Mr. Cappelli knew the terms of the lease agreement - not financial but <br />how long they intend to be there and Mr. Cappelli stated he did not know but he knew it <br />was not a year to year type of agreement.
