MINUTES OF ZONING BOARD OF APPEALS MEETING HELD MAY 12, 2009

Present: Lloyd Frink, Chairman, Frank Barresi, Vice Chairman, Kristina Costa,
Scott Davis and Lisa Cobb, Attorney

Absent: Allen Firstenberg

Others Present:
Janet Barresi Tony Vetrano
Kevin Ward Chris Relyea
Bob Relyea D. Cruz
Maria Cruz Larry MacIsaac

Meeting was called to order at 7:30 p.m.

MR. AND MRS. FRANK BARRESI, 5 MAPLE STREET
First on the agenda was the public hearing on the request of Mr. and Mrs. Frank Barresi,
5 Maple Street seeking a variance from Section 151-16(A) of the Zoning Ordinance to be
able to construct a larger front porch to their house at 5 Maple Street - required for front
setback is 15 ft. and proposed will be 7’4”. It was stated for the record that Mr. Barresi
will recuse himself from the Board for this hearing. Mr. Barresi submitted his legal
notices and notice of public hearing which was published in the Poughkeepsie Journal on
May 1, 2009. It was also noted that the Dutchess County Dept. of Planning had
responded to the zoning referral with a “Matter of Local Concern” comment.

Mr. Barresi stated that currently they have a porch on the house that is approximately 6
1/2 ft. wide and 5 ft. deep - he would like to replace it with a covered porch - 18 ft. wide -
6’4” deep - therefore requiring a variance of 8’6”. (Note: The legal notice listed 7’4” in
error). The house was originally built in 1937 and originally the property line went to the
curb - sometime later the Village deemed it appropriate to put in sidewalks and took
some of the frontyard from the property. Interestingly enough while they took Mr.
Barresi’s frontyard - they did not go further up the street - so there are houses farther up
Maple Street on the same side as Mr. Barresi’s that do not have sidewalks.

Mr. Frink asked when the existing garage was constructed and Mr. Barresi answered at
the time the house was built and has never been enlarged, altered or replaced as long as
Mr. Barresi has been living there. It was stated that the width of the sidewalk is at least
36” and was replaced last year. Mr. Frink then asked Mr. Barresi what he meant by the
word “curb” when he states measurements were taken from the edge of the curb and he
answered from the edge of the
