<br /> <br /> <br /> <br />MINUTES OF THE ZONING BOARD OF APPEALS MEETING HELD 9/16/09 <br /> <br />Present: Lloyd Frink, Chairman, Frank Barresi, Allen Firstenberg, Kristina Costa <br /> <br />Absent: Scott Davis <br /> <br />Others Present: <br /> Peg O’Leary Sheila Rosewhite Dolfinger <br /> Raymond Rosewhite Dolfinger Cathy Relyea <br /> Kevin Ward Sarah Bower <br /> Harry Terbush David Dookie <br /> Harry Wenning Mark Grossjung <br /> Charles Norman Art Buckley <br /> Nazmi Berisha Josine Fekete <br /> Frank Cannizzaro Mike Berta <br /> Matthew Noviello Lisa Cobb, Attorney for Village <br /> <br />Meeting was called to order at 7:30 p.m. Secretary took role - it was noted that Mr. <br />Davis was absent. <br /> <br />Mr. Frink made a motion to go into Executive Session to consult with Counsel. Motion <br />was seconded by Ms. Costa. On roll call vote - Ms. Costa - aye, Mr. Firstenberg - Aye, <br />Mr. Barresi - Aye, Mr. Frink - Aye and Mr. Davis - Absent. Board went into Executive <br />Session at 7:30 p.m. The Board reconvened at 8:00 p.m. - and it was stated that all <br />members previously present were still present. <br /> <br />FRANK CANNIZZARO, 3 ELM STREET <br />Public hearing on the request of Frank Cannizzaro seeking a variance from Section 151- <br />19(A) of the Zoning Ordinance to be able to have a three family house in a two family <br />zone and seeking the following area variances (1) front yard setback - existing is 12,83 ft. <br />and required is 15 ft., (2) lot depth - required is 100 ft. and existing is 84.34 ft., and (3) lot <br />size - required is 15,000 sq. ft. and provided is 10,890 sq. ft. Mr. Berta (Architect for the <br />project) was present along with the owner Mr. Frank Cannizzaro. Notice of mailings and <br />notice of publication were given to the Board. Secretary stated that Dutchess County <br />Department of Planning had responded to the zoning referral with a “matter of local <br />concern” comment. Mr. Berta stated the house is currently a two family house and they <br />want to add an additional apartment. There is sufficient parking - they will be just <br />building on top of what is currently existing. Mr. Frink asked if applicant had appeared <br />before the Planning Board and he answered he is scheduled to appear before the Planning <br />Board at their October 1, 2009 meeting. It was stated that there was a short form EAF <br />attached to Mr. Cannizzaro’s use variance application. Mr. Frink asked applicant why he <br />felt the need to construct a third apartment in a two family zone. Applicant stated he <br />needed help with making payments on the mortgage. The outstanding mortgage on the <br />property is approximately $172,000.00. Mr. Frink then asked what the current <br />assessment of the property was and applicant answered he did not know. Mr. Frink asked <br />Mr. Berta as an Architect what was his estimate for the cost of construction - and he <br /> <br /> <br /> <br /> <br />
