The regular meeting of the Village Board of Trustees was held on <br />Wednesday, February 13, 1991 in the Village Hail. <br /> <br />Pledge of Allegiance. <br />After the Pledge of Allegiance there was a moment of silent <br />meditation for our soldiers in the Middle East. <br /> <br />Roll call: Present: Mayor Hemingway, Tr. Costello, Tr. Kolb~ Tr. <br />Fisch, Tr. Bovino~ Tr. Napoleon and Attorney Viglotti. <br />Trustee Buckley was absent. He was at the hospital with his son who <br />was recently injured in a car accident. <br /> <br />Minutes of the last regular meeting of the Village Board of Trustees <br />held January 9, 1991 and minutes of the special meeting of the Board <br />of Trustees held January 22nd, 1991 had been duplicated and <br />previously presented to the Board members. <br /> <br />Minutes of the January ~ 1~1 meeting. <br /> <br />Mayor Hemingway reported an addition to the minutes on page 3 under <br />Communications . The minutes should read "Mayor Hemingway deferred <br />action on this request until 1-22-91 (Workshop session) reporting <br />this session would be a special voting meeting. The special voting <br />meeting as stated would be to go to resolution to bond for the pumper <br />truck). <br /> <br />Motion by Tr. Bovino, seconded by Tr. Fisch that the ~bove mentioned <br />minutes be accepted with corrections and additions. Carried. <br /> <br />Minutes of the January 22~ 1991 special voting meeting. <br /> <br />Tr. Napoleon stated that he wished to read a statement pertaining to <br />the 1-22-91 minutes. <br /> <br />Tr. NaPoleon prefaced his remarks saying that as an elected official <br />of the Village he took an oath to follow the letter of the Law in the <br />performance of his duties. <br /> <br />Tr. Napoleons statement was as follows: "I raise the question as to <br />the legality of the January 22~ 1991 meeting. The criteria for a <br />special meeting are as follows: <br />1. Notice to be given to all Board members in time to study the <br />agenda's of a special meeting. 2. Notice of the meeting must be <br />given to the public and caused to be published in a newspaper of <br />general circulation. 3. Notice to the public must be accompanied by <br />posting in one or more designated public locations." <br /> <br />Tr. Napoleon stated that two of these criteria were not met. "The <br />opinion of the Law was given to me by the Legal Department of the New <br />York State Comptrollers Office. I was also informed by their legal <br />department that if the letter of the. Law is not followed by the <br />Village Board~ the burden of bringing action against the Mayor and <br />Board of Trustees rests solely with me." <br /> <br />Meeting of Feb. 13th~ 1991 - Page #1 <br /> <br /> <br />
