<br />MINUTES OF ZONING BOARD OF APPEALS MEETING HELD MARCH 9, 2010 <br /> <br />Present: Lloyd Frink, Chairman, Frank Barresi, Vice Chairman, Scott Davis, Allen <br />Firstenberg, Lisa Cobb, Attorney and Mary Ann Loncto, Secretary <br /> <br />Absent: Kristina Costa <br /> <br />Others Present: John Chase James Chase <br /> Rob Alfonso Kevin McCourt <br /> Michael DePompeis <br /> <br />Meeting was called to order at 7:30 p.m. Secretary took roll call – Ms. Costa absent. <br /> <br />Mr. Frink stated he had completed three hours of training within the past month – and he gave <br />copies of his certificates to the Secretary to file. <br /> <br />MICHAEL DEPOMPEIS, 12-14 LOWER HENRY STREET <br />Continuation of a public hearing originally held last month on the request of the applicant, Mr. <br />baof the Zoning Ordinance to be able to alter a non-conforming use at 12-14 Lower Henry <br />Street. Mr. Frink stated to the applicant that at last month’s meeting the Board had asked him to <br />submit proposed plans for their review. This plan included the way the property looked before <br />any construction took place. Mr. DePompeis stated he dug through his “archives” and found <br />what the former architect was proposing a few years ago and it is pretty close to what was there. <br />(The plans belonged to Mr. Alfred Capelli). Verbally Mr. DePompeis stated that he would end <br />up with two bedrooms in each downstairs unit and three bedrooms in each upstairs unit and the <br />two sides were mirror images of each other. Mr. Frink asked applicant if it was his testimony <br />that the two bedrooms existed in both downstairs apartments prior to taking any action to them <br />and applicant answered yes – and the three bedrooms in each unit upstairs – yes but basically the <br />attic was proposed to be storage and I told the tenants that it was to be used for storage and the <br />tenants made the space as habitable areas (bedrooms). Mr. Frink then asked applicant if his plan <br />was to have habitation in the attic and he answered yes it is – they were proposing to use it for <br />bedrooms. They have proposed a sprinkler system for the house – everything is currently being <br />brought up to the current New York State Building and Fire Codes. Mr. Frink then asked Mr. <br />DePompeis if the top story on each unit contains three bedrooms and he answered yes it did – the <br />attic space includes two bedrooms and storage space on the side. It was stated that the roof is not <br />being raised. He stated that he has owned the house for 14 years. Mr. Frink then asked him if he <br />was making any structural alterations other than alterations necessary for compliance with <br />current NYS/International Building Codes and he answered no other than putting the stairs in on <br />the side of the house to get into the basement. Mr. Frink asked how long the construction would <br />take and he answered about two months – in three months all construction would be complete <br />and the units would be ready for rental. Mr. Frink asked what outside construction would need <br />to be completed and applicant answered the siding and the roof which he is replacing with <br />asphalt shingles. He also will be replacing the sidewalk. <br /> <br />Mr. Barresi stated he would like to see some documentation on the parking and applicant stated <br />he is proposing what Mr. Capelli originally had laid out which is 6 parking spaces He went on to <br /> <br />
