A special meeting of the Village Board of Trustees was held on 10-16-80 <br />at 7:30 P.M. in the American Legion Hall. <br /> <br />Present: Mayor Synnett, Tr. Dolan, Tr. Moruzzl, Tr. Costa, Tr. DiGreoorio~ <br />Tr. Viglotti, Atty. Lyons and Eng. Paggi. <br /> <br />Motion by Tr. Moruzzi, seconded by Tr. DiGreGorio that the Mayor be <br />authorized to execute the contract with Delenn Bros. ExcavatinG for the <br />Maple Street sewer project in the amount of $13,994.00. Carried. <br /> <br />Mayor Synnett reported Village purchased bldg. at the corner of South <br />Ave. and West Academy St. and there were no tax liens on same. <br /> <br />Motion by Tr. Costa, seconded by Tr. DiGreGorio that the Mayor.be authorized <br />to sign contract with Tran Camp Contracting Corp. for %he demolition of the <br />above mentioned bld9. at a cost of $13,700. Carried. <br /> <br />Motion by Tr. Dolan, seconded by Tr. Costa that the $.w. Johnson Engine Co. <br />be authorized to purchase materials to refurbish the basement floor at <br />the Firehouse at a cost of $1,000. Carried. <br /> <br />Motion by Tr. Costa, seconded by Tr. Dolan that the Berbertch claim be <br />settled for $6,000. & the Village Treasurer be authorized to issue a check <br />in the above amount made payable to Attorney Peter Mour~lis, upon submission <br />of a General release. Carried. <br /> <br />Motion by Tr. Costa, seconded by Tr. Dolan that the followinG resolution <br />be adopted: <br /> <br />RESOLUTION AUTHORIZING THE PAYMENT OF TAX REFUNDS <br />IN PENDING CERTIORARI ACTION <br /> <br /> WHEREAS, an action has been commenced in Supreme Court, Dutchess County, <br />New York~ by Wappingers Falls Associates to review the Village assessment <br />of the real property of said petitioner for the assessment year 1979/1980 and <br /> <br /> WHEREAS, such action has been settled and compromised in a manner deemed to <br />be in the best interest of the Village, and a Stipulation of Discontinuance <br />has been entered therein reducinG the assessment on the subject property from <br />$1,300,000 to $827,000, all as previously authorized by this Board, and <br /> <br /> WHEREAS, prior to such compromise, Village taxes on the premises were paid <br />as follows: <br /> Taxes in the amount of $41~459.15 were paid by Wappinoers <br /> Falls Associates on July l~ 1979, on time and without penalty, and <br /> <br /> WHEREAS, by court order made and entered in the above referenced action <br />pursuant to stipulation~ the Village has been ordered and directed to refund <br />that portion of the tax paid in excess of what said tax would have been if the <br />respective assessment had been in the reduced amount above set forth~ such <br />refund to be made without the addition of interest thereto, and <br /> <br /> <br />
