<br />MINUTES OF ZONING BOARD OF APPEALS MEETING HELD JUNE 8, 2010 <br />Present: Lloyd Frink, Chairman, Scott Davis, John Kozak, Allen Firstenberg, Bryan <br />Murphy, Attorney Cobb and Mary Ann Loncto, Secretary <br /> <br />Absent: Frank Barresi <br /> <br />Others Present: <br /> Trustee Costa Anthony Bonavoglia <br /> Louis DiCocco Tom Walsh <br /> <br />Meeting was called to order at 7:30 p.m. <br /> <br />ANTHONY BONAVOGLIA, 7 MORAN AVENUE <br />First on the agenda was a public hearing on the request of Anthony V. Bonavoglia, d/b/a/ Dr. B. <br />Smiles Orthodontist, 7 Moran Avenue seeking a use variance from Section 151-12(H)(2)(a,b) of <br />the Zoning Ordinance to be able to have a wall sign at 7 Moran Avenue where only monument <br />and post and arm signs are allowed. Mr. Tom Walsh from Sign Language and Dr. Bonavoglia <br />were present. Dr. Bonavoglia gave the clerk his receipts from his notice of mailing and proof <br />that the legal notice was printed and paid for in the Poughkeepsie Journal. Dr. Bonavoglia stated <br />he has a small sign up now – he has been in this location for about 3 years and he feels that no <br />one knows he is there. Mr. Frink asked if in the three years that he has been there – has his <br />business increased and he stated that it has gone up a little but not as much as he expected – he <br />realizes that part of the problem may be the economy right now –but he also fees that his <br />exposure has something to do with it. Mr. Frink went on to stated that in Dr. Bonavoglia’s <br />written submitted he states that his building faces Route 9 and Dairy Queen blocks his façade <br />from being seen from Route 9 and asked him to elaborate on that statement. Dr. “B” stated that <br />Dairy Queen has a big sign and blocks his sign because it is a low to the ground monument sign. <br />Mr. Frink then asked applicant why does he want a wall sign rather than a post and arm sign or <br />larger monument sign and Mr. Walsh stated that the wall sign would be visible from Route 9 and <br />Moran Avenue runs parallel with Route 9 and he feels it is a unique location because of that. Dr. <br />“B” went on to state that his building does not face any residential properties so he does not feel <br />that it will cause any undue hardship to any residences surrounding his property. Mr. Walsh also <br />stated that based on the lineal frontage that they have on a public street – applicant would like to <br />use the calculation of 2 sq. ft. of sign per lineal foot of building frontage (the same calculation as <br />for the GB zone). Mr. Frink then asked Mr. Walsh if it was his testimony that the proposed sign <br />and logo conformed to the GB requirement and Mr. Walsh stated he believes it is a bit less. He <br />stated that the lineal frontage on Moran Avenue would be 32 ft. Mr. Frink asked the applicant <br />for his lot width and he was not sure of that answer. Mr. Frink asked applicant if he had <br />explored the possibility of installing a sign off the premises and he answered no he did not. Dr. <br />“B” stated he has been operating his business from 7 Moran Avenue for about 3 years but he <br />recently purchased the property in March of 2010. Mr. Frink then asked the applicant how the <br />mortgage payments compared to the lease payments and he answered they are about the same. <br />Mr. Frink stated that the applicant has stated two things – one that visibility is a problem and two <br />that the customers cannot find the business – would the customers be able to find the business if <br />there was a sign on the front that clearly demarcated that stated Dr. B’s Orthodontics instead of <br />the existing sign – in other words if I know that I am going to a business on Moran Avenue but I <br /> <br />
