<br />Minutes following the 03-14-12Village Board Meeting <br />Public Hearing <br /> <br />LOCAL LAW NO. 1 FOR THE YEAR 2012 <br /> <br /> <br /> A Local Law entitled “Local Law No. 1 for the year 2012, Amending <br />Section 148-9 of the Code of the Village of Wappingers Falls entitled “Care of Meters” <br />so as to create a subsection “C”. <br /> <br />BE IT ENACTED <br /> by the Board of Trustees of the Village of Wappingers <br />Falls, as follows: <br /> <br />SECTION 1: LEGISLATIVE INTENT <br /> The Village Board of the Village of Wappingers Falls has deemed it <br />necessary to amend the provisions of Section 148-9 of the Code entitled “Care of Meters” <br />and has created a subsection “C” regarding the same. <br /> <br /> <br />SECTION 2: <br /> Section 148-9 “Care of Meters” shall be amended so as to create a subsection “C” <br />with the following language: <br /> <br /> <br />C.If the consumer and/or consumer’s contractor damages a <br /> a meter, exterior touchpad and/or exterior radio, they will <br /> be responsible for the purchase and installation of the damaged <br /> equipment. <br /> <br />All other portions of this Section shall remain in full force and effect. <br />SECTION 3: SEVERABILITY <br /> <br /> If any provision of this chapter or the application thereof to any person or <br />circumstances is adjudged invalid by a court of competent jurisdiction, such judgment <br />shall not affect or impair the validity of the other provisions of the chapter or the <br />application thereof to other persons and circumstances. <br />SECTION 4: EFFECTIVE DATE <br /> This Local Law shall become effective immediately upon filing in the office of <br />the Secretary of State. <br /> <br />Mayor Alexander opened the Hearing at 7: PM. Attorney Viglotti said this change will <br />only effect the equipment if there is damage, the contractor will need to replace or pay. <br />Mayor Alexander asked the Board and Public if they had questions.
