<br />MINUTES OF THE ZONING BOARD OF APPEALS MEETING HELD 3/8/16 <br /> <br />Presesnt: Allen Firstenberg, Chairman, Bridget Gannon, Vice Chair, Rachel DiGrazia, <br />Heidi Murphy, Hilda Duque, Lou Viglotti (Attorney) and Mary Ann Loncto, Secretary <br /> <br />Absent: Frank Barresi <br /> <br />Others Present: Trustee Huber Trustee Komornik <br /> Beth Huber Jay Diesing <br /> Gary Baright <br /> <br />Meeting was called to order at 7:30 p.m. <br /> <br />Mr. Firstenberg stated that he had responded to the Planning Board stating that the Zoning Board <br />of Appeals had no objection to the Planning Board being Lead Agency for two projects: 6-20 <br />Marshall Road and Foam and Wash. <br /> <br />FOAM AND WASH, 1518-1520 ROUTE 9 <br />First on the agenda was the public hearing on the request of WF, LLC (Gary Baright), 7509 <br />North Broadway, Red Hook, NY 12571 requesting the following area variances to be able to <br />construct a new light industrial building on the existing Foam and Wash site at 1518-1520 Route <br />9: (1) Side yard setback (Table 2F of the Zoning Ordinance) – requiring 0’0” min./24’0” max and <br />requested is 28’3” on the south side and 60’6” on the north side, (2) Front yard setback (Table <br />2F of the Zoning Ordinance) – requiring 2’0” min/12’0” max and requested is 442’11” on the <br />west side and (3) Building Height (Table 2F of the Zoning Ordinance) requiring 72’0” (2 stories <br />min./6 stories max.) and requested is one (1) story. Mr. Gary Baright, owner of the property <br />and Mr. Jay Diesing, Architect were present. It was stated for the record that Dutchess County <br />Department of Planning had responded to the zoning referral with a “matter of local concern” <br />comment, there are no violations against this property, a copy of the published legal notice was <br />submitted and copies of the “certified mailings” were submitted. <br /> <br />Mr. Diesing stated that the proposal is to build a new building at the rear of the car wash site. It <br />will be a light industrial building – Foam and Wash will be using a portion of the building as <br />their maintenance facilities and will rent other spaces to tradesmen or other subcontractors. They <br />are renovating the front building – they have eliminated the detailing portion of the building and <br />it will be turned into an automatic car wash and two dog wash bays. The building is about <br />11,000 sq. ft. It will be a one story building. The front yard setback does sound like a very large <br />setback – but it is a large piece of property and there is no way the building could be built any <br />closer to the front because of the size of the building and the existing building already there. The <br />parking that is behind the Laundromat will be reconfigured. They also wanted to give the <br />residents of the apartments in the rear of the property a little bit more of a buffer – that is why <br />they were only looking to build a one story building. Mr. Firstenberg then asked about the <br />height variance – he stated that the building looked like a two story building and Mr. Diesing <br />answered that they designed the building to look like a two story building – even though its not. <br /> <br />Mr. Firstenberg stated that the Zoning Board of Appeals could not make a final determination <br />until the Planning Board closed SEQRA. At this point the Planning Board has declared their <br />Intent to be Lead Agency. <br /> <br />
