<br />MINUTES OF THE ZONING BOARD OF APPEALS MEETING HELD 8/9/16 <br /> <br />Present: Allen Firstenberg, Chairman, Bridget Gannon, Vice Chair, Frank Barresi, Rachel <br />DiGrazia and Lou Viglotti (Attorney). <br /> <br />Absent: Heidi Murphy and Hilda Duque <br /> <br />Others Present: <br /> William Povall <br /> <br />DUTCHESS SHOPPING PLAZA, 1582 ROUTE 9 <br />First item on the agenda is a public hearing on the request of Davis Fowler Group, LLC, 4 Nancy <br />Court, Wappingers Falls seeking an area variance from Article VII, Section 151-25(J) of the <br />Zoning Code to be able to have a sign larger then allowed by code – (allowed is 1 sq. ft. per <br />linear ft. of building face which is 14.4583 ft.) and requested is 20 sq. ft. for Village Gone Green <br />located at the Dutchess Shopping Plaza, 1582 Route 9, Unit #11. Property is located in a <br />CMU(1) zone, a public hearing on the request of Davis Fowler Group, LLC, 4 Nancy Court, <br />Wappingers Falls seeking an area variance from Article VII, Section 151-25(J) of the Zoning <br />Code to be able to have a sign larger then allowed by code – (allowed is 1 sq. ft. per linear ft. of <br />building face which is 14.2083 ft.) and requested is 20 sq. ft. for Los Hornitos located at the <br />Dutchess Shopping Plaza, 1582 Route 9, Unit #12. Property is located in a CMU(1) zone and a <br />public hearing on the request of Davis Fowler Group, LLC, 4 Nancy Court, Wappingers Falls <br />seeking an area variance from Article VII, Section 151-25(J) of the Zoning Code to be able to <br />have a sign larger then allowed by code – (allowed is 1 sq. ft. per linear ft. of building face which <br />is 19.3750 ft.) and requested is 20 sq. ft. for Uniforms Array located at the Dutchess Shopping <br />Plaza, 1582 Route 9, Unit #8. Property is located in a CMU(1) zone. Mr. William Povall <br />representing the Dutchess Shopping Plaza was present. It was stated that Dutchess County <br />Department of Planning had responded to the zoning referral with a “matter of local concern” <br />comment for all three submissions. Mr. Povall submitted to the Board a copy of the legal notice <br />publication and a copy of the certificate of mailing to property owners within 200 ft. Mr. <br />Firstenberg stated even though there are three public hearings tonight – he is treating all <br />discussion as one submission. Mr. Firstenberg then asked applicant if he had any objection to <br />the Board proceeding with this hearing as there was not a full board and applicant stated he had <br />no objection. <br /> <br />Mr. Povall stated that he had received approval from the Planning Board to redo the façade. <br />Along with this façade renovation – applicant will be replacing all signs and their goal is to make <br />them all uniform throughout the plaza. They proposed 11 signs to the Planning Board and <br />received approval for all signs contingent upon the ZBA granting approval for the three signs <br />that are too large. Ms. Gannon asked if the proposed signs were larger or smaller than the <br />existing signs and Mr. Povall stated they are smaller. He also stated that the signs will be wall <br />signs with gooseneck lights shining down to comply with the Zoning Code. All signs will be 2 ft. <br />high by 10 ft. long (20 sq. ft.) – 8 signs conform but Village Gone Green, Los Hornitos and <br />Uniforms Array’s tenant spaces are smaller than the required 20 ft. and do not conform with the <br />Zoning code. As a side note, applicant stated that the entire length of the plaza is 231 ft. and <br />with <br /> <br />
