A meeting was held on 10-25-82 at 7:00 m.M. in the Mesier Homestead to <br />discuss the issuance of a building permit to ~lr. & Mrs. ~rmstrong for <br />the property located at I69 %Jest Main Rt. for office space. <br /> <br />~resent: ~layor ~ynnett~ Tr. Greco, Tr. Ciopga, Tr. Costa~ Tr. Mazochi, <br />yr. Carey & Atty. misanel!i. <br /> <br />Other residents also present made part of the file;. <br /> <br />Motion by Tr. Costa, seconded by Tr. Grec~ that Mr. Gerald Pisanella <br />be retained by the Village to represent the Village in any matters which <br />may prove to be a conflict for the Village Atty. Carried. <br /> <br />May~r Synnett inquired as to how a permit was issued to Mr. & ~Xrs. <br />Armstron9 for the premises at 169 West Main St. <br /> <br />Zoning Officer Haubennestel reported he will have to 9o back to initial <br />time when people requested a permit. He stated people were told there <br />was difficulty with the premises in getting the Board to grant a <br />variance. <br />Mr. Haubennestel reported 2 previous uses were proposed: 1) Restaurant, <br />2) Hairdresser, and the County ~lannir~ Board recommended against both <br />changes. He stated zoning change would have to 9o to the Planning Ooard <br />for an opportunity to decide on which recommendation. <br />Mr. Haubennestgl repc~ted County Planning Board left decision for a zoninN <br />change to local judgement. He stated several meetings were held and <br />recommendations made wi~h the final recommendation from the ?lanning B.oard <br />that the property be rezoned Office Business. <br />Mr,.l{aubennestel reported Mr. & Mrs. Armstrong requested zoning change <br />to General Business and after a ~ublic Nearing was held, application was <br />denied. He stated that~ in response to a letter f~om the Armstrongs, he <br />wrote them and outlined permitted accessory uses in con~unction with the <br />mermitted Principal Uses for professional offices under Section 420-A . <br />of the Zoning Ordinance under Residential Districts. <br />Mr. Haubennestel discussed provisions outlined in the above section and <br />stated, based on the above, he issued building permit. <br />He reported he later received a communication from the Armstrongs that <br />they wanted to make permanent changes and plans were reviewed and revised. <br />~r. Haubennestel repo~ted that when revised plan had been received amd <br />reviewed by he a~d Mr. Galioto a letter of agreement was signed. <br />He stated he received a notice of a meeting on 10-21-8~ and m~t with Mr. <br />Pisanelli on 10-24-82. <br /> <br />Mr. misanelli stated there was no rezonin9 and Mr. Haubennestel replied <br />request had been denied and property was zoned Residential, <br />He stated he was interpreting permitted accessory uses and building permit <br />was issued based o~ the assumption that they would comply, with requirements. <br />Mr. Haubennestel reported that if not, gertificate of Occupancy will not <br />be issued. <br /> <br /> <br />
