<br /> <br />MINUTES OF ZONING BOARD OF APPEALS MEETING HELD JANUARY 10, 2017 <br /> <br />Present: Allen Firstenberg, Chairman, Bridget Gannon, Vice Chair, Heidi Murphy, Hilda Duque <br />and Attorney Lou Viglotti <br /> <br />Absent: Frank Barresi and Rachel DiGrazia <br /> <br />Others Present: <br /> Nancy Forrest <br /> <br />Meeting was called to order at 7:30 p.m. <br /> <br />HANNOUSH SQUARE (BANK PLAZA), 1655 ROUTE 9 <br />First on the agenda was the continuation of a public hearing on the request of GNS Group, Ltd., <br />97 N. Clinton Street, Poughkeepsie, NY representing Wappingers K Holding Pad, LLC, 444 <br />South Fulton Ave., Mt. Vernon, NY seeking two area variances to be able to have a Multi- <br />Tenant sign larger then allowed by code. Section 151-25(J)(3) states square foot of sign can only <br />be 36 sq. ft. and applicant is requesting 75 sq. ft. and Section 151-25(K)(2)(d)(3) which states no <br />multitenant sign or its support shall exceed a height of 15 ft. and applicant is requesting 17’6” in <br />height at 1655 Route 9 (Bank Plaza). Property is located in a CMU (Commercial Mixed Use) <br />District and is identified on the tax map as 6158-14-499381-0000. Ms. Nancy Forrest from <br />Gloede Signs was present and representing the owner of the sign. It was stated that there is a <br />consent form on file from the owners of the plaza. <br /> <br />Mr. Firstenberg explained to the applicant that that there was not a full Board present this <br />evening and if the hearing did come to a vote – it would have to be a unanimous vote to grant the <br />variances. He also stated he would make the same statement before the Public Hearing was <br />closed. Ms. Forrest stated she understood. Mr. Firstenberg stated at the conclusion of last <br />month’s meeting there were a few questions outstanding, i.e., (1) assurance that there would only <br />be one sign on the combined lot, (2) address the possibility as to whether or not this was an off <br />premise sign and (3) narrow down the applicant’s final proposal as to the exact size of the sign. <br />Ms. Forrest stated also at the conclusion of last month’s meeting it was stated that the owner <br />does not want to combine the lots and, therefore what type of mechanism could be put in place to <br />assure that in the future if one of the parcels were solid – there would only remain one sign for <br />both parcels. The owner stated he was going to speak with our Village Attorney. Attorney <br />Viglotti stated no one had contacted him regarding this proposal and the only person he had <br />spoken to was the Chairman of the ZBA – Mr. Firstenberg. Mr. Viglotti stated if the ZBA was <br />so inclined to grant the variances requested – a document would have to be put in place which <br />states that the applicant would combine the signage for both lots. This documentation would run <br />with the land, have to be in a recordable form and must be filed as a legal document. Again <br />Section 151-25(I)(1)(2) was discussed regarding (1) the area of a sign measured from the outer <br />dimensions of the frame, trim, or molding by which the sign is enclosed, where such features <br />exist, or from the outer edge of the signboard where none exists and (2) when a sign consists <br />of individual letters, symbols or characters, or where the overall shape of the sign is irregular, <br />the area shall be computed as the area of the smallest rectangle which encloses all of the <br />letters, symbols, characters of sign area.
