A Public Hearing o~ a proposed Local Law to a~end the provisions af the <br />Revised Zoning Ordinance with respect to gasoline service stations ' <br />and public garages was held on July 7, 1975 at 7~00 PoM. in the A~erican <br />Legion Hall. <br /> <br />Present: Nayor Synnett, Tr. Dolan, Tr. DiBerto, Tr. Bain, <br />Tr. Beldlng, Tr. Short and Arty. Lyons. <br /> <br />Atty. Lyons zeported this was proposed Local Law #1 o~ 1975 ~nd would a~end <br />Zoning O~dinance to allow the operation o~ gasoline stations in a Central <br />Business District wi~h a Special Permit. <br />He stated' this would establish addi~tional restrictions in other districts. <br />Atty. Lyohs reported notices have been sent the Towns of Wappinger and <br />Poughkeepsie. <br />He stated proposal was referred to the D.C[ Planning Board and they felt <br />matter should be determined locally. <br /> <br />Atty. Lyons read proposed Local Law. <br /> <br />Atty. A~d~tch addressed meeting stating he represented Trlson Company and ' <br />favored adoption of ~he amendment. <br />He Stated a~enchnen~ would facilitate improvements of property on Rte. 9, <br />which is no~ an eyesore. <br />Mr. Aldrich reported an orifice bldg. and a Hess Gasoline Station were proposed. <br />He stated station would make no~repairs, but just sell gasoline. <br />~t~. Aldrich repo~ted amendment would make all other ~tations conforming and <br />property would be more saleable. <br />He stated a special use permit would be required and Board off Appeals w~uld <br />t~apose ample safeguards and protection. <br />~. Aldrich reported Hess Station was a clean operation. <br /> <br />~ayor Synnett inquired if Mr. Aldrich was talking about the old l~v n A1 <br />Cleaners and he replied no, but they tried to buy same. <br /> <br />Atty. Lyons repo~ted that, in reference to the above mentioned bldg., Village <br />has ordinance which can compel an unsafe bldg. to be ~ade safe or removed. <br />He stated, if not, we have to e~cquire a Supreme Court order' which is expensive. <br /> <br />Letter was read fzoaMr. Ba~brlck, proprietor of Barbzlck's Shell Stations <br />outlining 15 reasons why proposal should be defeated. <br /> <br />ir. Mailler discussed talk in Mr. Barbrick's l~tter concerning abuse to <br />gasoline stations. <br />He stated service stations can survive o~ repairs while Hess only dlls gas. <br />~r. ~ailler reported ~hat he has been appearlngbefore the Village Bd. for <br />the last three years in an effort to have this eyesore removed and nothing <br />has been done. <br /> <br />~lr. Finnerman reported the right to put up station is given by the Zoning <br />Board of Appeals. and amendment doesn't automatically allow gas stations. <br />He stated a~endment ~ould be for the benefit of non conforming stations. <br /> <br /> <br />
