<br />MINUTES OF ZONING BOARD OF APPEALS MEETING HELD DECEMBER 12, 2017 <br /> <br />Present: Allen Firstenberg, Chairman, Bridget Gannon, Vice Chair, Rachel DiGrazia, <br />Heidi Murphy and Lou Viglotti (Attorney) <br /> <br />Absent: Loretta Holloway and Frank Barresi <br /> <br />Others Present: <br /> Chris Lapine Zeidan Nesheiwat <br /> <br />The meeting was called to order at 7:30 p.m. Motion by Mrs. DiGrazia and seconded by Mrs. <br />Murphy to approve the minutes from the November 14, 2017 meeting as amended: Page 4, <br />Paragraph #2, Line 8 should read, “….pumps to three pumps to avoid additional queuing….” <br />On roll call vote – Mrs. Murphy – Aye, Mrs. DiGrazia – Aye, Ms. Gannon – Abstain and Mr. <br />Firstenberg – Aye. <br /> <br />GASLAND – 2755 W. MAIN STREET <br />First on the agenda was the continuation of a public hearing on the request of Route 9D <br />Holdings, Inc. 989 Noxon Road, LaGrangeville, NY 12540 with a proposal to redevelop the site <br />located at 2755 West Main Street with a new gasoline station/convenience store with three pump <br />island (6 fueling positions) and two one bedroom apartments on the second floor. There are 8 <br />variances needed which were read into the record last month and are listed on the official <br />agenda. Mr. Chris Lapine from Chazen Companies and Mr. Zeidan Nesheiwat, owner of the <br />property were present. At this point Mr. Lapine reviewed the site plan. The first comment was <br />that Dutchess County Department of Planning felt the sign was too wide for the location along <br />the 9D corridor and also asked if applicant could reduce the height of the sign (although the sign <br />did conform to the Zoning Law regarding height). Applicant stated they reduced the height of <br />the sign 6” and reduced the width of the sign from 84” to 42” which reduced the square footage <br />of the sign by 25%. In regards to relocating the Sunoco emblem – the applicant proposed having <br />the Sunoco sign illuminated by a goose neck light fixture. As far as the illumination is <br />concerned – Gloede Sign Works has provided documentation stating that the units for LED signs <br />operate during the daylight hours at 3000-4000 nits and during the night at 300 to 400 NITS and <br />these requirements meet DOT regulations for this location. It was stated that the logo has been <br />reduced because of the reduction in the signage. The distance between pumps has been reduced <br />from 21.5’ to 21’, and the outer pump stalls have been reduced from 9’ to 8’. These <br />modifications allow a reduction in the length of the canopy over the pumps from 70’’ to 67”, <br />which creates additional landscape/green space in the southeast portion of the site. This also <br />results in an increase in the front setback along Clinton Street from 10 feet to 13 feet. A red <br />maple with fountain grass has been added along the southern property line to partially screen the <br />building from Route 9D. The two accesses to the site from Route 9D have been reduced in <br />width by three feet each to increase green space, while still allowing for adequate and safe <br />maneuvering of vehicles and trucks. And, lastly it was suggested that the concrete pad and tanks <br />be moved to the north of the canopy. However, a tanker typically parts for approximately 45 <br />minutes while filling the tanks, and this would obstruct vehicles from entering the site from <br />Route 9D as well as obstructing access to some of the parking spaces along the front of the <br /> <br /> <br />
