<br />MINUTES OF THE ZONING BOARD OF APPEALS MEETING HELD 1/9/18 <br /> <br />Present: Allen Firstenberg, Chairman, Bridget Gannon, Vice Chair, Rachel DiGrazia, <br />Heidi Murphy, Frank Barresi and Lisa Cobb (Attorney) <br /> <br />Absent: Lori Holloway <br /> <br />Others Present: Chris Lapine (Chazen Engineering) <br /> <br />Meeting was called to order at 7:30 p.m. At this point in the meeting Mr. Firstenberg welcomed <br />Attorney Cobb as the new Zoning Board of Appeals attorney. Ms. Gannon made a motion <br />expressing the appreciation of the Zoning Board of Appeals to former attorney Lou Viglotti (who <br />has retired) for his many many years of service to the ZBA. Motion was seconded by Mr. <br />Barresi. On roll call vote – Mrs. Murphy – Aye, Mrs. DiGrazia – Aye, Ms. Gannon – Aye, Mr. <br />Barresi - Aye and Mr. Firstenberg – Aye. <br /> <br />Mr. Firstenberg made a motion to approve the minutes of the December 12, 2017 meeting as <br />amended as follows: Add the discussion regarding parking tankers on the street – there was <br />some concern from Village Attorney Viglotti about liability for the Village and concerns from <br />the Zoning Board of Appeals regarding the sometimes nature of the street being one way, the <br />width of the street, the tanker on the street being an obstacle, fuel lines running across the <br />sidewalk and just an overall safety concern. Ms. Gannon seconded the motion. On roll call vote <br />– Mrs. Murphy – Aye, Mrs. DiGrazia – Aye, Ms. Gannon – Aye, Mr. Firstenberg – Aye and Mr. <br />Barresi – Abstain. <br /> <br />GASLAND PETROLEUM, 2755 W. MAIN STREET <br />First on the agenda was the continuation of the public hearing on the request of Route 9D <br />Holdings, Inc., 989 Noxon Road, LaGrangeville, NY 12540 with a proposal to redevelop the site <br />located at 2755 W. Main Street with a new gasoline station/convenience store with three pump <br />island (6 fueling positions) and two one bedroom apartments on the second floor. There are 8 <br />variances needed which were read into the record at the November 14, 2017 meeting and are <br />listed on the official agenda. Mr. Chris Lapine form Chazen Companies was present. Mr. <br />Firstenberg stated that the Planning Board has not yet closed SEQRA – therefore the Zoning <br />Board of Appeals will not be able to vote on the requests this evening. Mr. Firstenberg stated <br />that he had sent an email to the Planning Board on December 21, 2017 asking the assistance of <br />the Planning Board and their Consultants in assessing the impact of their signage and internally <br />illuminating the price portion of their sign using LED’s which are prohibited by the Zoning code. <br />Specifically he was interested in their views on the following three points: (1) Applicant is <br />proposing that they have LED lights operate during daylight at 3,000-4,000 NITS and during the <br />night at 300-400 NITS and asking if these values are regulated by the DOT and if they are <br />appropriate and correct, (2) What was the Planning Board’s views on environmental based <br />controls that adjust the brightness based on the current light levels rather than on a timer and (3) <br />what are the Planning Board’s views and experiences with manual and timed controls of the <br />brightness of the light. Mr. Firstenberg further stated he would be attending the Planning <br />Board’s January 11, 2018 meeting to discuss the above.
