A Public Hearing on two proposed local laws was held on <br />Wednesday, June 1~, 2000 in the American Legion. <br /> <br />1. Local Law No. 2 amending Section 1~3-63, Schedule XXV: <br />Handicapped Parking. <br /> <br />Mayor Belding read text of law which would create 2 <br />Handicapped parking spaces on the north side of Prospect <br />Street. <br /> <br />He said this legislation had previously been requested by the <br />Beth-E1 Baptist Church. <br /> <br />2. Local Law N. 3 amending Section 1~0-~0, Schedule 11: <br />Speed Limits <br /> <br />Mayor Belding read text of law which would reduce speed <br />limits on various streets in the Village to 25 mph. <br /> <br />Mr. Charles McClusky, 28 South Ave., discussed instance on <br />South Ave. where a t~uck was speeding excessively along South <br />Ave. and a Patrol car, parked in the vicinity, never moved. <br />He asked what was the point to reduce speed if we are not <br />getting enforcement. <br /> <br />Mr. Hugo VonBurg, 3~ Prospect St., said he rather see <br />enforcement of the Stop signs rather than a speed reduction <br />as in his neighborhood one out of three cars violates Stop <br />signs. <br /> <br />Tr. Cerino said speed reduction had been discussed previously <br />by the Board in conjunction with an Opinion of the State <br />Comptroller regarding same and that opinion seems to be in <br />contradiction to this legislation. <br /> <br />He discussed opinion which states "a village may not, <br />pursuant to V&T law, or by local law, impose a village-wide <br />maximum speed limit of 25 mph; a village may not establish <br />such speed limit within designated areas of the Village. A <br />village may, however, if separately and independently <br />justified on a case by case basis, designate one or more <br />portions of a village street, on a linear basis, as 25 mph <br />zones. T~. Cerino said this law doesn't do this <br /> <br />Tr. Lawrence said Franklindale Ave., along with Market <br />Street, experience vehicles travelling at excessive speeds. <br /> <br />Tr. Juliano speeding issue was discussed previously and the <br />Board agreed to a speed reduction for specific streets. <br />He said action was justified, a letter had been received <br />from NYSDOT approving same and the Village Attorney had <br />drafted the law. <br />Tr. Juliano said 25 mph was an appropriate and legal speed <br />limit as it was in effect in other corm~unities. <br /> <br /> <br />
