The regular July meeting of the Mayor and Village Board of Trustees was held on July 12, 2000 at 7:30 P.M, in the Wm. T. Garner Engine House (Meeting transferred to Fire House due to overcrowding at the Legion Hall). ROLL CALL: Present: Mayor Belding, Tr. Juliano, Tr. Cerino, Tr. Lawrence, Tr. Davis, Tr. Bain and Atty. Viglotti. Absent: Tr. Marshall (attending funeral out of state) RESOLUTIONS, PETITIONS: None Mr. Lloyd Frink addressed meeting relative to Zoning matters. Mr. Prink said the first issue was the revision of the rules of procedure for the ZBA of the Village of Wappingers Falls. He said existing rules have been in effect since 1968 and the the ZBA adopted new rules at its meeting held last evening; he asked Boards' consideration under Section 151.5A~ of the Code of the Village of Wappingers Falls, as to the a~option of these rules of procedure. He said, secondly, he would like to express his opinion on a recent Zoning appeal which had taken place. Mr. Frink said he agrees Village Board is entitled to hear petitions regarding Zoning appeals, however, he would like to remind Board that Section 151o15B2 of their Code, dictates that the ZBA is the top authority to hear these appeals. Mr. Frink said the third item involved a Personnel matter which generated this past Tuesday which partly involved a Building permit issued for 8 Clapp Ave. He said the action that ZBA had taken was litigated and a D.C. Supreme Court decision was rendered in this matter. Mr. Frink said the Judge's decision specifically said that the matter was to be referred to the ZBA for reconsideration and determination if any variance was needed; he said, contrary to this, a Building permit was issued without the knowledge of the ZBA and contrary to the Judge's decision. He said it has been over a week since he has been made aware of the situation and it took much contentiousness to resolve this matter and today he has been told, although not in writing, that it was rescinded;~ he said he wanted the Board to act to prevent this from re-occumring. Tr. Cerino questioned the above mentioned meeting being labelled as Personnel and Mr. Frink said he understood it to be a Personnel meeting as he had requested meeting with Zoning Committee and was told that was~ unnecessary as the subject would be discussed in a Personnel meeting.
