The regular July meeting of the Mayor and Village Board of <br />Trustees was held on July 12, 2000 at 7:30 P.M, in the Wm. T. <br />Garner Engine House (Meeting transferred to Fire House due to <br />overcrowding at the Legion Hall). <br /> <br />ROLL CALL: <br /> <br />Present: Mayor Belding, Tr. Juliano, Tr. Cerino, Tr. <br />Lawrence, Tr. Davis, Tr. Bain and Atty. Viglotti. <br /> <br />Absent: Tr. Marshall (attending funeral out of state) <br /> <br />RESOLUTIONS, PETITIONS: None <br /> <br />Mr. Lloyd Frink addressed meeting relative to Zoning matters. <br />Mr. Prink said the first issue was the revision of the rules <br />of procedure for the ZBA of the Village of Wappingers Falls. <br />He said existing rules have been in effect since 1968 and the <br />the ZBA adopted new rules at its meeting held last evening; <br />he asked Boards' consideration under Section 151.5A~ of the <br />Code of the Village of Wappingers Falls, as to the a~option <br />of these rules of procedure. <br /> <br />He said, secondly, he would like to express his opinion on a <br />recent Zoning appeal which had taken place. Mr. Frink said <br />he agrees Village Board is entitled to hear petitions <br />regarding Zoning appeals, however, he would like to remind <br />Board that Section 151o15B2 of their Code, dictates that the <br />ZBA is the top authority to hear these appeals. <br /> <br />Mr. Frink said the third item involved a Personnel matter <br />which generated this past Tuesday which partly involved a <br />Building permit issued for 8 Clapp Ave. <br />He said the action that ZBA had taken was litigated and a <br />D.C. Supreme Court decision was rendered in this matter. <br />Mr. Frink said the Judge's decision specifically said that <br />the matter was to be referred to the ZBA for reconsideration <br />and determination if any variance was needed; he said, <br />contrary to this, a Building permit was issued without the <br />knowledge of the ZBA and contrary to the Judge's decision. <br />He said it has been over a week since he has been made aware <br />of the situation and it took much contentiousness to resolve <br />this matter and today he has been told, although not in <br />writing, that it was rescinded;~ he said he wanted the Board <br />to act to prevent this from re-occumring. <br /> <br />Tr. Cerino questioned the above mentioned meeting being <br />labelled as Personnel and Mr. Frink said he understood it to <br />be a Personnel meeting as he had requested meeting with <br />Zoning Committee and was told that was~ unnecessary as the <br />subject would be discussed in a Personnel meeting. <br /> <br />Tr. Bain said he agreed with Mr. Frink as it should be <br />considered a Personnel meeting; he said it was an issue for <br /> <br /> <br />
