A special meeting of the Mayor and Village Board of Trustees w~s held on Wednesday, ._March 15, 1995 at 8:00 P.M. in the Village Hall. Present: ,Mayor Hinm~nn, Tr. DiDc~izio, Tr. Cerino, Tr. Shay, Tr. Traver and Tr. Hemingway. Tri Municipal representatives. J. Bain, R. Juliano, R. Olson. Mr. James Bain, Tri-.~cipal Chairman, reported purpose of the meeting was to have the Mayor and Village Board of Trustees adopt a resolution ratify- ing the vote of its C~%¥.~ ssioners calling for the awarding of Contracts Nos. 1 & 2 in conjunction with the Town of Wappinger for expansion of the Tri- Municipal Sewerage Treatment facility. Motion by Tr. Cerino, seconded by Tr. DiDcmizio tb~t the following resolution be adopted: WHEREAS, the Village of Wappingers Falls and the Town of Poughkeepsie have enter- ed into an Agreement pursuant to the General 5~kr~icipal Law wherein the Tri-Mun- icipal Sewer C~tssion was fonmed; and ?~EREAS, on July 10, 1991 said Cc~waission entered into an ~reement with the T~n of Wappinger for the expao~ion ofthe Tri-Municipal Sewage Treatment Facility located on Sheafe Road in the Town of Poughkeepsie; and WHERE~, said Agrc~--~nt of July 10, 1991 has been amended by an A~reement dated Seotember 1, 1994 regarding early entry~nd construction payment procedures; and WHEREAS, the original bonding resolutions were determined to be insufficient to pay the total costs of alllcontracts for work set forth in its July 10, 1991 and September 1, 1994 Agreements; and WHEREAS, the Town of Wappinger has adopted the necessary Resolutions to increase its bonding capacity andis undm_rtaking the steps to insure an increase in Long Term Financing Agreements currently in place; and WHEREAS, based upon the representations and warranties of the Town of Wappinger as set forth in the Agreement annexed hereto the Tri-Municipal Sewer Cc~mission has agreed to award the balance of contracts for work necessary under the July 10, 1991 and Septemeber 1, 1994 Agrc~ments without having in place the full Long Term bonding to pay for same. NOW, THEREFOR, BE IT RESOLVED as follows: 1. That the Village of Wappingers Falls does hereby ratify the vote of its C~,~',{ssioners calling for the awarding of Core, tracts Nos. 1 ~ 2 based upon the Town of Wa_upinger representations in the Agreement dated March 15, 1995 to be executed prior to the awarding of the aforeskid contracts, which agree~nt is annexed hereto as Exhibit "A" The foregoing Resolution was duly put to vote which resulted as follows: Mayor Edwin Hinzmaran (aye), Tr. Traver (aye), Tr. DiDomizio (aye), Tr. Cerino (aye), Tr. Shay (aye), Tr. Hemingway (aye). The resolution is hereby declared duly adopted.
