Minutes of Workshop Session Held August 30, 1988, American Legion <br />Hall, Spring St., ~appingers Falls, New York. <br /> <br />Those present: Mayor Hemtngway~ Trustees Greco, Ward, Komornik, <br />Nargrave, Breglia, Kolb$ Wendy Bush, Attorney-at-Law, substituted <br />for Village Attorney Viglotti who had a previous commitment. <br /> <br />Also present: Noward Erickson, U.S. Cablevision <br /> <br />Pu~.lic Heauinq: <br />Atty. Bush read the Legal Notice which appeared in the Southern <br />Dutchess News. She stated that the hearing was being held in regard <br />to adopting Local Law ~5 of the year 1988 entitled "Pedestrians right <br />of way in Crosswalks." <br />Atty. Bush then summarized Sections I, II, & III of the Law. <br /> (Copy of said Law is on file in the ViLlage Clerk's Office.) <br />It was stated that the minimum fine would be $100 and the maximum fine <br />would be $500. <br />Tr. Komornik asked ~ this would supercede the State law. <br />Tr. Greco stated that he did not know. <br />Tr. Breglia suggested that Atty. Viglotti look into this. <br />Mayor Memingway asked if anyone had any comments to make in regard to <br />this law. <br />Tr. Breglia felt that it was a good step to take. <br />Tr. Greco asked if this law would allow arrests. <br />Tr. Breglia sta~ed that many people do not know that this is a State <br />law. <br />DiScussion was held on the above and about crossings. <br />Tr. Komornik stated most accidents occur on the corner of Mill and <br />East Main Streets. <br />Tr. Breglia stated that he would like to see signs installed at the <br />entrances to the village. The signs should say something to the effect <br />that drivers must stop or fines wilt be imposed. <br />Discussion followed. <br /> <br />Tr. Greco questioned why DOT was not in attendance. He thought that <br />they were coming to discuss East Main St. <br />Tr. Breglia stated he spoke to a representative from DOT in r~gard to <br />signs. There should be signs near the Library and also on Market St. <br />Tr. KomOrnik SUggested that instead of Putting'the signs at the entrance <br />to village, they should be put within the ¥illage. <br />Discussion was held on ticketing. <br />Tr. Komornik stated this could be a problem to enforce. <br />Tr. Breglia stated it had to be intense. <br />Mayor Hemingwa¥ stated that you just can't tie up officers for this. <br />Discussion followed on radar and speedtraps. <br />Tr. Komornik feared that some of these tickets could be entrapment. <br />This should be'checked with the village attorney. <br />Tr. Breglia stated that the law should be enforced for two weeks. He <br />was willing to go on TV and explain the law to the commentators. Ne <br />said that the commentators could do the interview within the village. <br />It Should also be put in the Southern Dutchess News and the Poughkeepsie <br />Journal. <br /> It was pointed out that you cannot put this law into effect until it <br /> has been accepted by the State. It takes time for the law to be re- <br /> turned after it has been filed with the State. <br />Tr. Breglia stated that a law is the law. It should be enforced and <br />officers patrolling should do this. <br /> <br /> <br />
