Miscellaneous meeting of the Village Board of Trustees was held on Wed., <br />April 24,'1968 at 7::30 P.M. in the Mesier Homestead. <br /> <br />Those present: Acting Mayor Bain, <br />Fries, Tr. D.O. Napoleon, Tro Cheetham and Arty. Lyons. <br /> <br />Also present: Attorney Russell Aldrich, Attorney Norona, Mr. Kaymor and <br />Mr. & Mrs. Campilii. <br /> <br />Motion by Tr. Cheetham, seconded by Tr. Fries that the regular order of <br />business be dispensed with. Carried. <br /> <br />Att'y. Aldrich addressed meeting on behalf of his client, Mr. Kaynor and <br />B.N.&A, Realty Corp., reporting his client sold lake to the Village and <br />they anticipated use of the lake for residents of the Village of Wappingers <br />Falls. <br />He reported certain conditions in deed were imposed by both the Village id. <br />and BeN.~A. Realty Corp. and recommended negotiations continue on a friendly <br />basis, <br />Att'y. Aldrich stated certain geound rules or by-laws should have been <br />laid down and he answered Att'y. Lyons letter to protect his clients <br />interests x in that the Village has the lake and they have a power plant. <br />He reported Village has a vast investment as they have a,vast investment <br />and the 12" rule will tried to be adhered.to. <br /> <br /> He discussed closing of the gates, should water go below the 12" level <br /> and stated immediate action could result in a catastrophe as his client has <br />,obligations along with power plant. <br /> Atty. Aldrich reported initial proposal would permit ~olice Dept. to close <br /> gates after 15 minute notice and that this action takes the responsibility <br /> from his client and places it upon Village. <br /> He stated Policemen were not engineers, <br /> He proposed appointing a committee to lay ground rules, as his client intends <br /> to keep his part of agreement and not lower lake, bug 15 minute warning was <br /> not sufficient. <br /> Mr. Aldrich reported he would be happy to entertain ay agreeable solution. <br /> <br />Mr, Kaynor discussed operations of the generating plant reporting he is <br />drawing water 16 hrs. a day and keeps a record of the drawing, <br />He admitted lake went down below 12" level two days last winter when he <br />was vacationing, but stated his intention to abide by agreement. <br />Mr. Kaynor reported'he needed four hour notification before cl osing gates, <br />and a qualified person would be made available. <br /> <br />Tr. DiDomizio inquired as to how much water could be drawn in four hrs. and <br />Mre Kalrnor replied that this depended upon on how fast creek was running. <br /> <br />Mr. Kaynor reported he checks marker 5 times a day and knows exactly how <br />much water is drawn, <br /> <br /> Tr. A. Napoleon stated, it was his coneention, that if Mr. Kaynor doesn't <br />-want to draw water below 12" level, there was no need for a committee. <br /> <br />Discussion followed bn Village crews cleaning debris in front of spillway. <br /> <br /> <br />
