The regular meeting of the Village Board of Trustees was held on Wednesday, <br />Aug. 14, 1968, at 7:BO P.M. in the Mesier Homestead. <br /> <br />Those present: Mayor Furnari, Tr~. OiDomizio, Tr. A. Napoleon, Tr. Bain, Tr.' <br />Fries, Tr. D.O. Napoleon, Tr. Cheetham and Atty. Lyons. <br /> <br />Minutes of last regular meeting of the Village Board held July 10, 1968 had' <br />been duplicated and previously presented to the Bd. of Trustees. <br /> <br />Motion by Tr. DiDomizio, seconded by Tr. D.O. Napoleon that the above minutes <br />be accepted as written. Carried. <br /> <br />Petitions: None <br /> <br />Communications: <br /> <br />Letter was read from Village Planning Bd. concerning submission of a site plan <br />for Change of Zoning by Mr. & Mrs. Cecil Morgan. <br />They recommend Mr. & Mrs. Morgan submit a more detailed site plan to the Village <br />Bd. and request for a change of Zoning from Residential to Commercial. It is <br />also noted that a Variance will be required due to set backs. This is to be <br />presented by Zoning Bnforcement Officer. <br /> <br />Atty. Lyons reported this request was submitted by the Planning Bd. He reported <br />two seperate actions were involved: 1) A variance, which doesn't concern <br />Village Bd., but Zoning Bd. of Appeals & 2) a change of Zoning, which would <br />come first, from Residential to General Business. <br />Atty. Lyons reported Village Bd. would hold a Public Hearing if request was <br />contemplated or deny if not warranted. <br />He stated "spot zoning" is subject to Court scrutiny and from a legal point <br />of view is dangerous to do. <br /> <br />Tr. A. Napoleon reported Mr. Morgan is located in a R-1 zone, but there also <br />exists gas stations, delicatessans and various other businesses in the same' <br />area. He recommended granting request. <br /> <br />Tr. DiDomizio reported that due to the number of commercial properties in the <br />area, it couldn't be zoned residential. <br /> <br />Tr. D.O. Napoleon reported that according to new Zoning Map, all Main St. was <br />to be zoned residential. <br />He stated Village should either go along with 701,recommendation or remain <br />commercial. <br /> <br />Tr. DiDomizio reported a residential zone couldn't be maintained along a State <br />highway. <br /> <br />Tr. A. Napoleon reported new Zoning map was inconsistant between residential and <br />commercial in that they are trying to make a residential district out of the <br />old business district in the Village. <br /> <br />Tr. Bain reported Main St. has always been spotted with businesses. <br /> <br /> <br />
