Napoleon, Tr. Bain~ <br />Lawrence, Tr. Dog. Napoleon, Tr. Sabia, Att. MacDonald and Att. Lyons, <br /> <br />Others present: Mr. John Evans, Mr. Epsteins Tr.'Ted C~afft~ <br />John Berinato~ Mrs. Ciarfella and Mr. LoUis Diehl. <br /> <br />Notice of ~ublic Hearing was published in the W. & S.Do News on~o3-30-67. <br /> <br />Copies of Notices of Public Hearings were forwarded Village Planning <br />Dutch, ss County Planning ~d., Town of Wappinger Clerk and Town of Poughkeepsie <br />Clerk/ <br /> <br />Proposed ordinance made part of the minutes of the last regular Village Bd.s <br />meeting held March 8~ 1967, was read by Att. MacDonald. <br /> <br />Tr. A. Napoleon inquired if zoning would extend outside of Village and' Att. <br />MacDonald replied nbs although Village owned lake to Red Oaks Mills~ they <br />didn't have power to zone. <br /> <br />Tr. A. Napoleon inquired if Village could be held liable~ if an accident <br />occurred on the lakes and Att. MacDonald replied he rather not answer question <br />at this time. <br /> <br />Mr. MacDonald reported ordinance regulates developments not safey~ and deesntt <br />provide swimming facilities by the Village, <br /> <br />Mrs. Ciatfella inquired if ordinances was complete and Att. MaCDonald reported <br />ordinance was designed to protect lake as a water recreation area. <br />He, stated ordinance doesntt include trespassing on pr'irate property, etc. <br />and a committee would have to be appointed to adopt rules and regulations. <br /> <br />Mr. Evans stated Parcels of land have been previously zOned and this ordinance <br />would not effect private property. <br /> <br />Tr. A. Napoleon inquired if private land owners adjacent to the laker could <br />install a private beach with a permit from the Bd. of Appeals. <br />Att. MacDonald replied Village owns lake and this could be permitted~ if <br />exercised under the ordinance. <br />He reported Zoning O~dinance supercedes deed restrictions. <br /> <br /> Evans stated there was no urgent need to ~one the lake at the present time~ <br />accordtn~ to Planning Consultant. <br /> <br />Discussion followed on the placing of a permanant ra~t in the area of the lake <br />outside of Village limits as being included in ordinance. <br /> <br />Att. MacDonald reported non residents cannot be kept from using the lake but <br />Village can direct where facilities would be installed. <br /> <br /> <br />
