PUblic Hearing of the Village Board of Trustees was held on April 25, 196~ at <br />7:30 PoM. in the Nm. To Garner Co. <br /> <br />Those present: Mayor Furnari, Tr. VanVoorhis, Tr. DiDomizio, Tr. Bain, <br />Lawrence, Tr. Napoleon, T~o Sabia and Att. MacDonald° <br /> <br />Mayor Furnari opened hearing reporting application had been received from Time <br />Life, Inco for the installation of cabled television in the Villageo <br /> <br />N~tice of Public Hearing which was published in the April 5, 1966 edition of <br />the Wo & S.D. News reads as follows: <br /> <br />Notice is hereby given that pursuant to the provisions of Subdivision 39 of <br />Section 89'of the Village Law of the State of New York, a public hearing will <br />be held by the Village Board at the Wm. T. Garner Engine House, W. Academy St. <br />N~ppingerg Falls, Dutchess County, New York on the 25th day of April, 1966 at <br />7:30 PM, or as soon as therea£~er the same can be heard, upon a petition by <br />Time Life Broadcasting Company, Inc. of Time Life Building, Rockerfeller Center, <br />New York, New York, requesiing a franchise for a period of.twenty five (25) <br />years from the Village of Wappingers Falls, to construct, maint~n and operate <br />in the present and future streets, alleys and public places of theVillage of <br />Wappingers Falls, lines, cables and necessary wiring and other apparatus for <br />for the purpose of receiving, amplifying and distributing television radio <br />signals to said Village of Wappingers Falls and the inhabitants thereof subject <br />to the following provisions: <br />a. That all& apparatus to be erected shall be erecte~ so as not to interfere <br />with the traffic on or over the streets and alleys in said Village and that <br />the same shall be erected under the supervision of the Village of Wappin9ers <br /> Falls as to such location, providing that such location shall not be a vested <br />interest,and the same shall be removed by ~etitioner whenever the same restrict <br />orobsturct the OPeration or laocation of said streets or public places. <br />b. That no cables or Wires shall be affixed to pole facilities of any public <br />utility in said Village of Wappingers Falls without petitioner first obtaining <br />the permission and consent of said aforementioned public utility companies. <br />c. That allstreets and sidewalks disturbed or damaged in the construction or <br />maintneance of said cable lines and other appurtenances shall be promptly re- <br />paired by the petitioner at petitioner's expense and to the satisfaction to <br />the Village of Wappingers Falls. <br />d. That petitioner shall be subject to all,ordinances now if force or that may <br />be hereafter enacted relative to the use of the streets and public places of <br />the Village of Wappin~ers Falls. <br />e. That said franchise shall be for a peiiod of twenty five (25) years, Unless <br />sooner terminated. <br />f. That all materials to be used in such service are to be of slightly appear~ce <br />and placed so as not to obstruct traffi~ and any changes thereof are to be made <br />only with the consent of the appropriate public officer of the Village of <br />Wappingers Falls. <br />g. That petitioner agrees to provide service to all areas of the Villag as its <br />facilities are extended and to sell its service to all willin9 and able to p~y <br />for the same° <br /> <br /> <br />
