159 <br /> <br />Special Meeting of the Village B~ard of Trustees was held on Wednesday, <br />March 2~, 1965 at 7:S0 P.M. in the Mesier Homestead. <br /> <br />Those present: Mayor Furnari, Tr. VanVoorhis, Tr. DiDomizio~ Tr. Temple, <br />Tr. Bain, Tr. Napoleon~ Tr. Cheetham and Att. Pearse. <br /> <br />Purpose of the meeting to act on the rezoning of Mr. Marshall's property. <br />Public Hearing on the rezoning was held on March l, 1965. <br /> <br />Att. Pearse asked the Mayor for an adjournment of one week to answer <br />certain questions such as action pending for Injunction and the remov- <br />al of the Stay. He wanted ample time to examine issues. <br /> <br />Required vote on the rezoning of Marshall(s property would be different <br />in that a three-quarter vote would be necessary to carry. <br /> <br />Att. Lyons reported he would go along with Att. Pearse on an adjourn- <br />ment but that one week's adjournment would §o beyond the SO day wait- <br />ing period. <br /> <br />Motion by Tr. Napoleon and seconded by Tr. Bain that meeting go into <br />Executive session. Carried. <br /> <br />Executive Session. <br /> <br />Motion by Tr. DiDomizio and seconded by Tr. VanVoorhis that meeting <br />return to regular session. Carried. <br /> <br />Protest signed by the Wappingers Apartments~ Brack Construction Corp., <br />Ritter Construction Corp.~ and the Rock Hill Apartments was read by <br />Att. Pearse and served on the Village Board. <br /> <br />Mr. Dugan reported this protest should have been filed on the night of <br />the Public Hearing or prior to. <br /> <br />Att. Pearse requested an a~journemet for an examination of protest~ <br />provided time is kept within 30 day period. <br /> <br />Sedtion ~79 of the Village Law was discussed which required three- <br />quarters vote of the Village Board to carry. <br /> <br />Resolution was read by James Lyons and presented to the Village Bd. for <br />consideration. Mr. Lyons reported resolution was drawn up for Plann- <br />ing Board but that he had made changes in an attempt to fit both. <br /> <br />Mr. Lyons stated that if resolution is adopted any applica~ making a <br />request or previously requested must comply with requirements. <br /> <br />Mr. Phillips reported resolution can't apply just to 80 acres without <br />applying to whole Village. <br /> <br /> <br />
