Public Hearing on the Ordinance pertaining to the closing of stores <br />on certian holidays was held on May 3, 196~ at 7:30 P.M. in the <br />Mesier Homestead. <br /> <br />Those present: T~ Cheetham$ Tr. No, one appeared to voice an opinion. <br /> <br />Special Meeting of the Board o~ Trustees was held at 8:00 P.M. in <br />the Mesier HO~estead. <br />Those present : Acting Chairman: Tr. VanVoorhis, Tr. Bain, Tr. Cheetham, <br />Tr. Napoleon and Att. Pearse. <br /> <br />The following Ordinance was read by the Clerk: <br />WHEREAS, by Sect. 86 of the General Municipal Law of the State of New <br />York~ The Town Board of the Town of ?oughkeepsie~as a political sub- <br />division of the State and the Village Board of T~ustees of the Village <br />of Wappingers Falls as a similar political subdivision of the state <br />have identical power and authority for the enactment of an ordinance <br />in regulation of the conducting of business involving the public <br />sale or offering for sale of any property on Memorial Day, the 30th. <br />day of May in any year and/ or Independence Day, the Sth day of July <br />in any year, and <br /> <br /> WHEREAS, the Village of Wappingers Falls by its Board of Trustees <br />determines to enact such regulatory ordinance in harmony with that <br />already enacted by the Town Board of the said Town of Poughkeepsie~ <br />now, therefore, be it <br /> <br />RESOLVED AND ORDAINED: <br /> <br /> SECTION 1. Territory Affected: This ordinance shall be applicable <br />to all territroy within the territorial limits of the Village of <br />Wappingers Falls; <br /> <br /> SECTION 2. Definitions: The term "person" as used in this ord- <br />inance shall include an individual, society, club, firm, partnership, <br />corporation or association of persons, and the singular number shall <br />include the plural numbers. The term "public selling or offering for <br />sale of any property" shall exclude such sales as are set forth in <br />Section 2147 of the Penal Law of the State of New York: <br /> <br /> Section 3. Restrictions on Commercial and Business Establish- <br />ments;No person shall engage in or permit any public selling or <br />offering for sale of any property on Memorial DaN, the thirtieth <br />~? of May in any year, and/or Independence Day, the fourth day of <br />July in any year~ and any such public selling or offering 2or sale <br />on any Memorial Day and~ or Independence Day is hereby prohibited: <br /> <br /> <br />
